If it has a forward grip and no stock the ATF says it is not a rifle and not a pistol (it is an other. Just like a stripped lower. ). . By this logic then it is not an assault weapong by NYS definitions.

The state will classify it as an assault weapon that's a pistol. If a law enforcement officer decides to arrest you, he will see an unregistered AR with a pistol brace or no stock and a forward grip. You then have to somehow convince a jury that it's not a pistol.
Here is an AR pistol.
And here is what you will build as just a firearm or whatever nonsense you think will skirt the law.
The so called "only a firearm" looks exactly as to what Penal law 265 describes as an AW pistol.

Looks to me like a pistol with a forward grip installed that's illegal under penal Law 265. Hands behind your back please! Take it up with a court and explain to them that it isn't a pistol.

(ii) a thumbhole stock;
(iii) a second handgrip or a protruding grip that can be held by the non-trigger hand;

(v) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
(vi) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned;
(vii) a manufactured weight of fifty ounces or more when the pistol is unloaded;
