Appeals Court Upholds Gibson’s Bakery Massive Verdict Against Oberlin College​

The Ohio 9th District Court of Appeals has just issued a decision in the Gibson’s Bakery v. Oberlin College case.

For those of you new to the case, Gibson’s Bakery was a 5th generation family business in Oberlin, Ohio, near the Oberlin College campus. It served baked goods to the public and also to the student dining service, as well as operating a general convenience store. As with many other small businesses, student shoplifting was epidemic, as we covered, Student journalist: Shoplifting at Gibson’s Bakery was part of Oberlin College’s “Culture of Theft”


On November 10, 2020, the Court heard oral argument on (1) the appeal byOberlin College and Dean of Students Meredith Raimando seeking to overturn the compensatory and punitive damage awards totalling, after reduction under Ohio tort reform law, $25 million, plus over $6 million in attorney’s fees, bringing the judgment to over $32 million, and (2) the cross-appeal by Gibson’s Bakery and two members of the Gibson family (including the widow of the late David Gibson) seeking to restore the full $33 million punitive damages award, arguing the tort reform reduction was unconstitutional, which would add back about $15 million to the judgment.

About time. I've been following this case since the beginning. I hope Oberlin goes bankrupt.

The pathetic thing beyond what Oberlin did here is the fact that it was founded as a Christian school that was the first in the nation to insist that both women and blacks had to be allowed to attend university. Further, the professors, staff, administration, and the supporters of the school were all anti-slavery, abolitionists to the point of being members of or supporting the Underground Railroad, worked in a lot of charitable movements and institutions, and were great supporters of the US Constitution and our Republican form of government.

If this whole debacle is not a commentary on how far our nation has fallen I don't know what is.

Oberlin went from champions of Liberty and education for all men and women, crusaders against actual racism and the evils of slavery, promoters of the General Welfare, and staunch upholders of moral integrity, to.....

A university system that made up an incident of "racism" almost completely from whole cloth and obvious, abject lies, to destroy a well known, long time local business that was in fact one of their own vendors that supplied baked goods for the campus.

I too hope this ends up with Oberlin in total bankruptcy and its doors locked. Further, it is my frank opinion that some of the people who carried out this act of wickedness ought be charged and spend years in the slam for it. Won't happen, but it should.

First I want the settlement to be paid in full. Then the college can go bankrupt. I doubt it will just as I doubt anyone in the administration learned any lessons from this incident. I would bet all my money there is nothing but resentment within the college and a general feeling they were screwed over by a racist justice system. So much for an institution of higher "education."

Another question is:

How much of the settlement ends up being paid for with tax dollars instead of out of the endowments and other schemes universities use to build huge financial stockpiles for themselves while shoving many of the costs of the "higher education" they provide onto the public trough?
