War Footing or Ukraine? – Biden Waives Section 303 of DPA Related to Weapons, Ammunition, Explosives and Components​

he Defense Production Act (DPA 1950 amended, pdf) essentially is a legislative hurdle that stops the executive from stepping into the private sector and restricting trade, commerce or manufacturing, unless the President says a critical shortage of “xxxx” is present and national security is at stake. It prevents citizens from the threat of govt nationalization of resource “xxxx”.

…”specifically for defense organic industrial base supply chains critical to the Department of Defense and critical supply chains for electronics, kinetic capabilities, castings and forgings, minerals and materials, and power and energy storage.” (link)


In the event the President makes a national security determination, he/she is required to inform congress, invoke the waiver authority, and identify which sectors he/she is now outlining as a national security… such that government purchase orders take precedent in the supply of “xxxx”. Yesterday, President Biden invoked this authority.

In the interim, ammunition might become a little harder to find.

Inside a sprawling factory just off the President Biden Expressway in downtown Scranton, Pennsylvania, the future arsenal of Ukraine’s war effort is being forged, one red hot artillery shell at a time.

Running full-tilt, as it was on a recent January morning, the Scranton Army Ammunition Plant churns out roughly 11,000 artillery shells a month. That may seem like a lot, but the Ukrainian military often fires that many shells over just a few days.
The Army is planning a 500% increase in artillery shell production, from 15,000 a month to 70,000, according to Army acquisition chief Doug Bush. Much of that increase will be fulfilled by the Scranton plant, which makes a large share of the country’s supply of artillery shells.
A recent report authored by Seth Jones, the director of the Center for Strategic and International Studies’ International Security Program, warns that America’s assistance to Ukraine has “depleted US stocks of some types of weapon systems and munitions, such as Stinger surface-to-air missiles, 155mm howitzers and ammunition, and Javelin anti-tank missile systems.”

Jones also told CNN that CSIS war games showed in a Pacific conflict, the US runs out of “key long range munitions,” like long-range anti-ship missiles, in “less than a week of the war.”

My earliest memory on the tv was the Korean War, THE BIG PICTURE, and Eisenhower being nominated at the 1952 convention, displaceing Howdy doody.

The Indochinese wars were already on and the Berlin airlift/cold War had begun in 1948, and Mau attacked us in N Korea.

Vietnam, the anti communist black ops we ran in Africa, C America, Grenada and Panama and then Desert Storm and the 2003 gulf wars in Iraq and Afghansitan...............

Munitions are needed and history tells us that we will get back to building them at a war's pace.

If not supplying the Ukraine, we would be fighting with NATO in Poland, Chechoslovakia and Hungary for starters, using our troops. We have delayed this, to weaken Russia and prepare to anhilate China once and for all, as a communist state.
