Maybe the answer to the cam question is to allow the switch, but make having the camera off prima facia evidence the officer was covering something up if there are any allegations ?

Given the choice, I'd take their pensions in a civil suit if if was the kid.
If they were found to not be following the "use of force" policy, their qualified immunity should be toast.
I have already said that I am opposed to this type of action...
In saying that, let's look at the other side of it. The man was spitting at the officers, he was violent even though he was restrained. How about this guy just act like a normal person and do what he is instructed to do. In order to be placed in the chair, he had to have been completely out of control from the start.

Sheriffs deputies aren't cops. Even they will say it.
Correct in a way. Most, at least the ones I know, just claim to be Deputies. Nothing more, nothing less.
Someone asks a cop what he does for a living, most reply, "I'm a cop".
A Deputy just responds with " I work for the Sheriff".

If they can declare that having 5 guns means you were planning on selling them, they can declare that turning off the body cam means you were planning on hiding something.
N.Y. law is replete with examples of the state declaring things evidence when they aren't.

So, most of upstate doesn't have any cops ?
They may not technically be, but they meet the definition most people use when they talk about cops.
People who's primary job is arresting criminals are cops as far as most people are concerned.
If someone calls 911 and says send the cops, and you get sent, then you are a cop in my book, anything else is debating semantics.

What is a cop? Is it not a slag word? The line between deputy and police officer is a thin one (around here anyway). They are both revenuers.

Sure, he's a dirtball, but they are paid to deal with dirtballs. It's like a garbage man complaining about the smell.
If he's spitting, put a hood on him, they are paid to deal with these guys, not punish them for being dirtballs.
If I take my truck to the mechanic, and he kicks the fender when he skins his knuckles on a stuck bolt, I'm going to be pissed, at him. It's the same thing, even if the bolt was a POS to get off....
I have to agree with that. I consider one of my strengths to be my ability to control my emotions when dealing with people like that. My best example would be last year when a punk in our cells peed in a cup and handed it to me. Some of it splashed on my hand. I looked down at it, walked into the waiting area and handed the cup to his mother whom he didn't know had come to see him. Then I washed my hands and went back to what I was doing.
