Pair of Democrats introduce bill to require background checks on ammunition sales
The bill, introduced by Sen. Richard Blumenthal, D-Conn., in the Senate and Rep. Debbie Wasserman Schultz, D-Fla., in the House, seeks to close a “loophole” in federal law that prohibits criminals, domestic abusers and the mentally ill from purchasing ammunition, but does not require a background check to prevent such illegal purchases from occurring.

“Ammunition sales should be subject to the same legal requirements as firearm sales, and that includes instant background checks,” Blumenthal said in a statement. “The same laws that prevent dangerous individuals from purchasing firearms also prohibit them from amassing arsenals of ammunition, with one major loophole: there are no background checks for ammunition sales to enforce the law. Closing this ridiculous loophole is a common sense component of a comprehensive strategy to reduce gun violence.”

Bill Summary: Ammunition Background Check Act of 2013

Senator Blumenthal's legislation requires instant background checks on sales of ammunition.

Under current law, it is illegal to sell both firearms and ammunition to certain groups, including,

  • felons
  • fugitives
  • drug addicts
  • people deemed “mentally defective” by a court, or committed to a mental institution
  • persons under a protective order for, or convicted of, domestic abuse
But under current law, firearms and ammunition are not treated the same way. If a felon walks into a store licensed to sell firearms and tries to buy a gun, the store will run an instant background check of an FBI database (National Instant Background Check System, or NICS), and the purchase will be denied. By contrast, if a felon walks into the same store to buy ammunition, he can load up an entire shopping cart with ammunition, pay up, and walk out, no questions asked. The store is not required to run an instant background check for ammo purchases. In fact, the store couldn't run a background check even if it wanted to – because the FBI database is only available for firearms purchases, not for ammo.

Studies show it can help keep ‘bad guys with guns’ from perpetrating another mass slaughter like the one we witnessed at Marjory Stoneman Douglas High School in my Broward County community, or the thousands of other acts of gun violence that devastate communities across the country.

Progressive strategists target overloading NICS as a means to throttle down gun / ammo sales through additional delays, costs, and bearacracy. They also believe sales would be totally suspended during system overload, failures or outages.

Want to stop gun violence now? Regulate bullets

Because bullets are so widely available, people often wonder whether ammunition can be regulated at all. The answer is yes.

Most regulatory efforts today focus only on restricting access to guns, but this was not always the case. The Gun Control Act of 1968 required all retailers to log ammunition sales and prohibited all mail-order purchases. (The restrictions were lifted two decades later by President Reagan's Firearms Owners Protection Act.)


Not only would it be possible to implement similar regulations today, but it also would be easier to carry them out.

A good place to start is the factories where bullets are manufactured. Strict control on the production and sale of unusually dangerous ammunition would be straightforward, since such sales can now be monitored digitally.

It's also cheaper than ever to mark and trace bullets with microscopic codes or serial numbers, which help law enforcement solve gun-related crimes. This data can be registered with the buyer's personal information at the time of purchase.

What's more, there are far fewer producers of ammunition than there are producers of firearms, according to Small Arms Analytics, a research firm. This makes the ammunition industry easier to regulate.

The U.S. imports ammunition from more than 30 countries. Russia is the top exporter of ammunition to the U.S., according to Small Arms Analytics. Between 2012 and 2017, Russia supplied Americans with more than 4.7 billion rounds. Mexican companies supplied an additional 2.2 billion rounds during the same period. These and other foreign suppliers can be taxed. Doing so will probably encourage more ammunition production in the U.S., which would be more easily subject to regulation.

At a minimum, state governments and retailers should introduce simple background checks on ammunition sales. At least six states have already taken this step. California and New York require point-of-sale checks, while Connecticut, Illinois, Massachusetts and New Jersey require licenses or permits to purchase or possess bullets.

We should start having background checks at the gas pump too, to weed out the reckless drivers and those whose licenses are suspended. If it saves just one life...

Fine, if they are hell-bent on requiring background checks on Rights, put it on ALL Rights.
