The article was clearly written by an uninformed anti-gun reporter. The text states that "....the three sold more than 100 assault rifles in violation of the SAFE Act."
We all know that the SAFE Act never mentions "assault rifles." Well know that assault rifles, by definition, must have a select fire option that allows for automatic or burst mode. So, no assault rifles were sold.
The SAFE Act merely criminalizes cosmetic and comfort features on semiautomatic modern sporting rifles by bastardizing the nomenclature and telling the lay public that such firearms are the fictitious political construct known as "assault weapons."

With the 2nd Circus Court already having said UNSAFE is legal and unambiguous, the defendants have little defense using 2A. Their best bet would be to delay this pending a SCOTUS correction, which won't be for two years, minimum. Meanwhile the corrupt NYS machine will continue to bleed them dry hoping for a plea. Why wouldn't NYS do so? They have plenty of funds, they are pleasing the emperor, and even if SCOTUS overturns this post-incarceration those individuals who perpetrated the crime of persecution will go unharmed.

Using the SAFE Act like this is just reenforcing the anti-gun propaganda and lending this unconstitutional law legitimacy that it doesn't deserve. He has been charged with other crimes. Read the criminal complaint. Grand Larceny, Falsification of Business Records are just two of the "other crimes." Once the trial gets started, the "revelations" will surprise.

No..he was just charged with them. Additional charges he answered to in Court when he was arraigned for the Safe Act bullshit. Like I've been saying all along, the so called "selling of illegal rifles" is just one component of this case. Once details of his alleged criminal acts are released you'll see what I mean.
My advice, keep an open mind and a fool and his legal defense fund dollars are soon parted.

To be completely honest, I bought 2 handguns from the guy when he was in business. He worked where I work until he was told he no longer worked here. His legal problems run much deeper than any alleged Safe Act violations.

Listen. I don't know what else he's involved in as others are insinuating but not telling. Whatever it is, I could care less. Let him get charged on that and deal with that on his own. But since it's a gun related charge that is all in the news..... Supporting him is supporting ourselves.
What I do know is that he's being charged with an unconstitutional crime that would not have been if he had his shop a few miles away past an imaginary line in PA. They are parading him around for that and patting themselves on the back for a job well done with the Unsafe Act. For that alone, he is worthy of support.

ROCHESTER, N.Y. -- A retired Monroe County Court Judge is now part of the legal team defending Kordell Jackson, the boss of a now-closed gun shop in Henrietta, who is accused of illegally selling more than 100 assault rifles.
Patricia Marks says she is coming out of retirement because she's outraged over what is happening to Kordell Jackson and is concerned for justice in this case.
Jackson of West Henrietta and two of his former employees: Joshua Perkins, of Irondequoit, and Ken Youngren, of Alfred, are accused of violating the state's SAFE Act. They pleaded not guilty.
The attorney general's office says the investigation began in 2014 when the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives noticed some irregularities in records obtained from Jackson Guns and Ammo.
When police went to Perkins' home on an unrelated matter last week, they say they found dozens of illegal high capacity ammunition feeding devices and four assault rifles among other things.
Jackson, Perkins and Youngren each multiple felony charges including criminal sale of a firearm in the first degree.
Law enforcement has reportedly recovered most of the illegally sold weapons.
"There are always people who violate the law but at least we now have a law that bans assault rifles in the State of New York," said Gov. Andrew Cuomo, D-New York, who was in Buffalo on Wednesday.
Dave Jenkins, a licenced firearms instructor, says there is still some confusion over the SAFE Act three years after it was inacted.
"The thing that makes the SAFE Act confusing is the ambiguous language," Jenkins said. "Whether it was done on purpose or by accident, because it was rushed through its process and it wasn't allowed its due process and the public wasn't afforded the chance to comment on the very thing that took a lot of their rights away and abilities away."
Because it's semiautomatic, many consider the AR-15 an assault weapon. Jenkins calls it a basic sporting rifle used for target shooting and hunting.
The governor disagrees saying only a small number of gun owners use the AR-15 for sport.
"It is a killing machine, an assault rifle. It's one thing in the military, it's another thing in the hands of a madman and that's what we've seen again and again and again. It is too high a price to pay in my opinion," Cuomo said.
Jenkins believes any gun can kill if in the wrong hands. He says the SAFE Act is making it more difficult for for law abiding citizens to enjoy recreational shooting.
"Rifle sports in New York State have basically disappeared dramatically because of the SAFE Act," Jenkins said. "Not only was it passed to give us the perception of safety and the governor's doing something about it, it actually created the opposite. More crime has resulted and people that could enjoy sport can't."

Last I knew...Grand Larceny and Falsification of Business Records weren't Safe Act violations and these charges are in addition to the alleged Safe Act violations.. It's also "prudent" to recognize that the investigation of JGS didn't begin with so called illegal assault weapon sales. It began with the discovery by the ATF of approximately 100 pistols and long guns that were sold out of his shop that were either improperly booked in and out of inventory or were never booked in or out of inventory to begin with.
Then there's the number of "clients" of which he took their firearms in on consignment or Court ordered seizure, sold them, then never fully compensated the owners .
Then there was the seizure of inventory to pay debts.
None of his problems started with alleged Safe Act violations. They were discoveries after the fact and every bit of the above information was and remains "open source" and was provided to those who cared to pay attention to it by the local media.
Those of us with dealers licenses or work for/with those with dealers licenses KNOW the Safe Act is unconstitutional. We also KNOW that unless and until SCOTUS says it is we are required to sell MSR's in specific configurations and we KNOW that we are required to do so from day one of the passage of the Safe Act. Same as a car dealer can't sell a car that won't pass inspection.
