Gun Group Warns State Lawmakers Considering 5-Round Mag Limit

Pro-gun advocates in one state are warning that lawmakers, in conjunction with police officials, could set a magazine capacity limit as low as five rounds.


The Hawaii Firearms Coalition, a non-partisan gun rights group in the Aloha State, met earlier this month with state Rep. Gregg Takayama, chair of the important Public Safety, Veterans, & Military Affairs Committee in the Hawaii House of Representatives. The reason for meeting with Takayama, a Democrat, is that his committee frequently hears gun bills first.


What the HFC found out was that an updated magazine restriction will soon be on the table in the state.


“Whilst it was unclear what the actual number will be, Representative Gregg Takayama gave the impression that the starting point would be five rounds,” said the HFC via social media. “This would not only significantly reduce the number of rounds in rifles, but would also reduce the number of rounds allowed in pistols by 50 percent.”

It was struck only because the State was allowing the sale of 10rd mags and expecting people to load only 7.

I'm of the opinion that if the situation had involved 5 round mags, 5 rounds max, the word arbitrary would never had been used, and we would have been stuck with it, from a statute standpoint.

Yep. If the original law was 5 round magazines for rifles, it would have held. For pistols it wouldn’t have though.

Correct. The court is ok with arbitrary limits as long as the limit and magazine capacity are equal. So if the law banned magazines over 7 rounds, then we would still have it.
