Obviously I am missing something.
they can do what they want just don't support the BATFE or DEA in the state .. like call them .. like they do with ICE .. my guess ..
Yeah what I don't get is how can you buy a gun. Personally don't partake but really couldn't give a damn whether they legalize or not. But make it consistent across the board. If its legal it should be legal everywhere. Same if its not. Not really up on this because it really doesn't matter to me but where exactly does Marijuana fall under Federal purview under US Constitution?
yeah see first sentence in my response I hear you.I just applied for a C&R.
It asked right out if I used illegal drugs. As the ATF is Federal, if I used MaryJane - even legally under Mass Law - it would remain illegal federally.
And my C&R would be denied.
As my Mass LTC would be.
yeah see first sentence in my response I hear you.
They can't.I don't smoke pot but have a number of friends that do and frankly my opinion is its no worse than beer. Constitutionally speaking not sure where pot has been enumerated to Federal jurisdiction seems to me it should be a matter of states rights. Be that as it may Federal law is in play. So don't see how a person who smokes pot can "legally" pass 4473 to buy gun. Of course we all know it happens everyday. So with that said make it legal across board or don't. Not really invested one way or the other.
Just said I'm not that invested not that I don't care lol...They can't.
It asks on the 4473 if you are a user of Marijuana. Yes = denied.
I don't understand the "it doesn't personally affect me, so I don't really care" mindset though. Not specifically at you. You should care about freedoms that don't personally affect you probably even more than the ones that do, as squashing that nonsense early stops the spread.
That didn't happen with Marijuana and some people think it should still be illegal, but to this date can't come up with an argument as to why without conflating two issues.
If it was "wait...ban a plant!? Fuck right off!" instead of "Well I don't use it, so who cares?" this wouldn't even be an issue
Following the law is now optional ?
They had to amend the constitution to ban alcohol. They can't.

Taxation is theft. They had to amend the constitution to ban alcohol.
Then they decided they could pass taxes they don't let you pay and bypass the entire messy process.
Marijuana *isn't* illegal federally. It's just taxed, but you aren't allowed to pay the tax.
SCOTUS *really* needs to reign in their abuse of the power to tax. Taxes should only be allowed for revenue. If you don't allow someone to pay, then it's *not* a revenue source and they should be exempt from the rule.
Same goes for post '86 machine guns BTW.
A good solution for all this would be to say that anyone can send in a money order for any tax. If they cash it, you're legal, if they don’t then you're exempt. Just keep proof you sent it.
The closest they will come is "they can tax anything they want as much as they want"I'm not a smoker, and I'm no fan of illegal drugs in general, but where in the Constitution does it say that the Federal Government has the right to regulate marijuana? Can anyone tell me?
Yeah, but if they don't ever provide a way to pay the tax then it's a round about way to ban things that have no right being banned. The closest they will come is "they can tax anything they want as much as they want"
or "The commerce clause lets them regulate anything anyone ever thought of spending money on".
Both are pure BS, but that no longer matters.
Yep, they've learned that trick well.Y

Yep, they've learned that trick well.
They use it a lot.
Government only has 3 ways to take money from citizens. Taxes, fines, and fees.
Fees are voluntary (they can only withhold a service of you don’t pay).
Fines have a lot of restrictions about what they can be used for.
But Taxes, they use like a $2 whore.
They take a lot of things they can't legally fine people for, but call it a tax instead and get away with it.
Obamacare is the most egregious recent example. But there are many more.
There's probably a large portion of the population that smoke pot, and would be larger if not for drug testing. Pot stays in your system for a long time.I know a few people that smoke weed on a regular basis. If you didn't personally know them you would never know... Good responsible people, good consistent earners, good reliable family men.
Smoking weed does not automatically turn someone into a dirty lazy hippy... LOL
Weed does not make someone an instant loser as the stereotype suggests.
The loser who smokes weed would be a loser with or without smoking weed regardless... IMO
When is taxation not backed up with threats of violence?Fixed it for you @Darth
