To clarify that cellular device cases modeled in the form of a firearm
are banned for sale and possession in the New York State.
SUMMARY OF PROVISIONS:
Section one amends subdivision 2 of section 871 of the General Business
law, expanding the definition of an "imitation weapon" to include an
attachment to an electronic device.
Section two sets the effective date.
JUSTIFICATION:
Due to recent increases in the sale of cellular device cases that
imitate the grip of a pistol, a dangerous new threat has arisen. Both
police officers and anti-gun advocates have deep concerns regarding
these cases that allow for others to perceive the owner is carrying or
holding a gun. This is a tragedy waiting to happen and these imitation
weapon cases will only serve to endanger those who own them and the
police officers who patrol our streets. It is in the public's best
interest to ban the sale and possession of these imitation weapon cases
and to prevent tragedies in New York State."
