The most intrusive new rule of evidence is the right of the defense attorneys and the principal, upon court order, to visit, inspect and record the crime scene. Imagine you’ve already been the victim of a crime and you learn that you must allow the accused person back onto your property in order to better build their defense. This is certainly being victimized twice, but particularly in crimes against people such as murder, rape, and assaults.
... Think about this folks ...You have a loved one who was violently raped almost killed in their home .... and the defendant has the right to walk into your house for an inspection ... Talk about intimidation of a witness..
This is a right that already exists. It comes from a document most of us here cherish.
Do explain. I don't see it jumping out at me anywhere, and this is very definitely NOT "face your accuser".
I consider it part of due process and the right to challenge the evidence.
You make it sound like the defendant is going to be traipsing through the rape victim's bedroom. Which is hyperbolic.
Why would it be improper for a defendant to send his lawyers and investigators to a crime scene to do their own investigation, provided the government has concluded their own, and actually indicted the defendant?
I grant you I do way more civil stuff and most of the criminal stuff we do is white collar so not my area of expertise but the statement you made struck me as being a bit excitable.

This is a great step in the right direcrion . We are talking about people in jail. They are not convicted of any crime just awaiting trial. People are innocent until proven guilty. Not to be locked up until they prove innocence or can pay to be released. Unless there is evidence of them being a danger to society people should not be locked up .

If it is successful, which I doubt, this will save millions and millions of dollars for the tax payers.
