The story is misleading.

The arguments yesterday had to do with two other cases (Armed Career Criminal Act cases).

Kavanagh did not vote in this case because he was not on the court when the case was argued.

This "decision" was just an appeal of a stay. Kavanaugh didn't participate because the appeal reached SCOTUS before he was sworn in.

It hasn't reached the Supreme Court on the merits. If it ever did, then Kavanaugh would presumably hear argument and sign an opinion.

For what it's worth I think it's beyond stupid to require an ID with a street address on it, and I would be pissed too. Not even a passport would satisfy that. It's a dumb law, but I don't live in North Dakota.

I was driving with two people to a work meeting and they told me in NYS they are asked for ID to vote. I have never been and I don’t believe them actually. They both swearnit though.

I haven't in my life either.

However by law "ID" (which can be a bill) is required the first time you vote in the state if you didn't provide any when you registered to vote. I think providing a NYS driver license ID number on a mailed registration form is sufficient to be considered "ID". Maybe even the last 4 numbers of your SSN. And it's rare enough that I expect a lot of poll workers may never be trained to ask ever.

I think the NY rule is a good compromise. You should have some proof that you're eligible to register but showing ID every time you vote is overkill. Sign the book and they can compare, or the poll workers can challenge you if they think you're popping up more than once to vote.

The law is Election Law § 8-303. It looks like the only time you would be asked to show ID is the first time you vote if you first registered after 2003 and you registered by mail and checked the box on the form that you don't have a NYS Driver (or nondriver) ID or a social security number. That's pretty damn few people and I wonder how they even flag that to the poll workers. Even if you registered in person they'd probably just have you fill the form out and wouldn't ask to see any ID if you completed that section.

Initial voter identification

1. Applicability.  Each board of elections, in a uniform and nondiscriminatory manner, shall require a voter to meet the requirements of subdivision two of this section if:

(b) the individual has not previously voted in an election for federal office in the jurisdiction of the board of elections.

2. Requirements. (a) In general.  An individual meets the requirements of this subdivision if the individual:

Here in Westchester, I made a point of showing the polling official my driver's license when pointing to my name and signature in the register. They said, in an annoyed voice, "Put that away! We don't need to see that!"
