More losing by the state that thinks they can just do as they please. This is good news and maybe we could sue them under this at some point over gun control especially if they ignore Supreme Court rulings going forward. Maybe even immigration laws since they are violating federal laws on immigration. Could get interesting

So it's just a money grab. They want part of the "proceeds" for people who travel across that segment of the Thruway, and to stop the collection of tolls at one exit (I assume that exit is on the Seneca's land).
Good luck. Even if they win, NYS will just move the camera/receiver towers to either end of that stretch of the highway, just off Seneca Land, and resume normal operations.
No toll collections at the exits anymore. These were removed over a year ago. But if there is only one exit that is "free" for Senecas, what good is it? You can't go anywhere without being charged.

And I guarantee if the Senecas win NYS will say "ok, it's your stretch of highway. Fix it yourself or pay us an exorbitant fee to do so."

They basically did that already. That section of highway saw almost no maintenance since the last little barbeque was held there. Just this past year NYS was forced to fix that section of road. NYS uses the same tactic down in Salamanca. That section of highway cutting through the reservation gets no repairs.

NYS has a wild hair up it's ass when it comes to the various tribes in the State. They antagonize and provoke, then expect the nations to cooperate. NYS reneges on every agreement, pact or treaty they make with the nations, and then gets pissy when the nations don't comply with Albany's demands.

That Fed judge is a FOOL, in capital letters.

SCOTUS wrapped up most of the Indian Claims when the Late Justice Ginsberg wrote the majority opinion, that the Indians were fucked..................but could buy land............................. and were not exempt from Eminent Domain that is guaranteed in the US constitution for land acquistion, for legitmate public reasons, like Interstate Highways.

The Indians there tried to build an off ramp that you can still see today on the t-way as it passes thru that Res.

Indians own no land on Reservations, and they live in a matriarchal controlled socialist communist society..........any Indian can take over another Indians home on the res, as onlly the tribe owns the land............as it was for 10,0000 year....the stongest take what they want.

That would leave a mark, they would have to go way out of the way through Gowanda. The terrain wouldn't permit building a bypass.

If you look at the rez in that area it's long and narrow and coincidentally runs almost perpendicular to the thruway, so for the thruway to circumvent their territory on an alternate route it would have to go pretty far out of the way likely leading to eminent domain fights

Wha tthe Indians really want, is an Interchange, off and on ramps, to sell gasoline and cigs from.
Let them pay for the Interchange construction and build a Casino there too.
