Only positive here is this story proves the legal point I constantly make regarding NY’s menacing law and “printing”. No charges, because menacing is not an open ended slippery slope.
That said, this article provides a few “read between the lines” moments which make it clear the involved cops overreacted. Is the incident lawsuit worthy? I don’t know about that. But when the Chief says, “people don’t like being helped to the ground by the police,” it’s pretty obvious force was used which was likely unnecessary.

That would have been great. Then as Amherst police chief says "We dusted him off and apologized, and we were on our way."
I’d be looking for details on the original report to police. If someone falsely reported he was waving his firearm around I’d go after them for filing the false report and precipitating a potentially deadly situation that caused the injury. Aren’t there consequences for filing a false report?

I'm glad he's a retired correction officer not random citizen guy. He is more likely to be taken seriously and it's an example that it can happen to anyone.
The police seemed to grossely and negligently over react
Sounds like the APD needs systemic retraining.
I hope whoever made the exaggerating false police report faces charges.
I hope this guy sues for a lot.

My wife told me about this weeks ago. Medical office grape vine. From what my wife heard the guy identified himself as a retired corrections officer and legal ccw before the police took him down. Also the guy failed to comply, police said get on ground, he said no, they tazed him.
Also from what I heard when he was on the phone, it hasn't a happy call. When he turned his jacket opened and the "lady" seen the pistol, twice. Then told the receptionist.
Also wife told me the woman was from Iran.

What was the suspected crime? Possession of gun that can be legally owned and carried was grounds to ask to see a pistol permit and that is all. Did police witness an exposed firearm not according to them. One person caused a knee jerk reaction. I love the story, witness states gun was exposed then it gets bumped up to man waving a gun along the way.
