A Town of Stafford homeowner shot an intruder who had forced his way into the house on November 5. On Thursday, that man was arrested after a lengthy hospital stay.

He did the wrong thing, and the right thing.

In his favor: he had a weapon available that he was ready, willing and able to use to defend his and his wife's life.

On the other hand: never familiarized nor practiced. Poor choice of ammunition for a defense scenario, although he did disable that attacker with apparently one shot.

And so he fired, and the threat was stopped. The attacker lived.

Well, the good news is he stopped the threat. Further good news, that when the threat was over, he withheld his fire.

Be careful. When you make the decision to shoot an attacker, and that individual is unable to further threaten you with serious physical injury or death, your legal right to defend yourself has just run into a brick wall.

He broke into your home. You took your best shot. He's down and out, and has no further physical means to threaten you. Dead or alive, you stop there. That doesn't give you legal standing to go commando and empty all 8 shots of your shotgun into him, and blast his guts all over your walls, just cuz.

Further, doing YOUR trial, depending on your jurisdiction and circumstances, the jury will get an up close and personal look at your choice of weaponry as an exhibition in court. How will your weapon look to the average man or woman, who, when it comes to guns, doesn't know shit from shinola.

Always be standing on firm legal ground. If it hasn't happened to you yet, count your blessings, and consider your choices very carefully.
