Mossberg shockwave aokay, black ace tactical nope?

Ok so as we all know by now the Mossberg 590 shockwave (and the Remington tac-14, to keep things simple, shockwave will mean both of these.) are hella legal, even here in New York.

If you are not sure how they are legal, well it's simple, they are not shotguns but firearms. Over all length is 26 inches, not designed to be fired from the shoulder, blah blah blah. No tax stamp or ARE jazz.

Now with that being said, Black Ace Tacticals makes a bunch of different models of their firearm all same concept different execution. (Pistol grip with Sig brace) The thing is, all but one of their models say not shipping to NY Call and others.

Now my issue is why can we get a shockwave but not a black aces. My only guess is that the company themselves doesn't want to try and interpret our bull shit dumb laws and to cover their own asses decided nope not shipping to that state.

My local ffl has even contacted black aces, they won't sell to NY,
I'm still guessing it's a business choice of theirs more than anything

I have spoke with BAT and this is nothing but their choice. No legal standing, they just choose to not sell or ship these to NY among a few other states.
