Buffalo, NY – On September 20, 2019, at approximately 6:23 p.m., State Police were requested by U.S. Customs and Border Protection Patrol to respond to the Peace Bridge Plaza in the city of Buffalo.

During an investigation, it was determined that Skyler R. Kruse, 33, of Omaha, NB, mistakenly drove into Canada and upon returning to the United States, he declared to Customs Officers that he was in possession of a 9 mm Springfield XD9 semi-automatic pistol. The pistol was loaded with a 16 round 9 mm magazine. Additionally, Kruse had an unloaded 16 round capacity 9 mm magazine in the vehicle.

I agree. However he was entering the US from a different country. Yes, that does make a difference.

I think coming from Canada has nothing to do with anything. Suppose I came from Canada and got my car searched after coming back here from there and currently on US Soil in NY when my pistol was discovered. What would have happened? Nothing.

He was surrendered to the purple tied oath breakers to pay for a crime that isn’t supposed to be a crime.

If he had a NY pistol permit, or he had crossed from Canada into almost any other bordering state besides NY he would have been good.

He might have been illegal in Canada, but it wasn't the Canadians who caught him. I can't see the US guards sending him back to Canada for having something that was illegal there but isn't here.

My objective back then was to go to state troopers, or something federal. I can tell you without a shadow of a doubt, that if i "found" an otherwise law abiding citizen carrying a gun, that legally owned his gun in his hime state, Id advise him to lock it away, unloaded in his trunk and GTFO of NY before one of the antigun (only LE should have guns crowd) found him.

Id use my position in LE to help honest gun owners stay out of trouble, and work on educating fellow officers.

Who can say they didnt drive somewhere were it was not ny safe BS compliant at a given point? This is obvius because you dont simply go to other countries with guns loaded or not unless you have a specific permint.
But it is just to also see how the system is designed to make criminals of regular citizens.

Possibly, maybe more so when I was younger, but at my current age and with my awareness of the world I think that I would be cutting a lot of people slack. If I caught regular guys that we're not necessarily doing anything wrong except unfortunately getting caught with so-called illegal guns, I could look the other way.

But, I can also Imagine that there would be times I wouldn't be able to depending on who was around and what the circumstances were, without putting my own career in jeopardy.

Cops are paid to enforce the law and they do not make the laws, but they do have discretion and if there are victimless crimes and no other witnesses there would be quite wide latitude with that discretion.

I am a commercial construction superintendent, I am paid to maintain schedules, budget, safety, compliance with the contract documents, along with many other things. If I let people build with whatever materials they wanted and with whatever methods made it fastest for them, even if it contradicted the contract, I can lose my job, and I'm not willing to do that at large.

However, I have discretion and there are times when it's reasonable and if its in compliance with the spirit of the contract, I can make exceptions. It's no different with anybody's job in a supervisory role. I don't write the contracts that we sign with the government agencies, I just have to enforce it with our subcontractors.

I think we have a couple current retired Feds here. I do not know if they have discretion at the bridge crossings.

I dont believe that *most people would give up their career/retirement/benefits/etc.. in most scenarios.
