New York could expand paid family leave policy

    ALBANY - New Yorkers could have expanded access to bereavement leave starting in 2020.

    The state Legislature voted last week to expand the paid family leave requirements in New York to include time off following the death of a family member. If signed into law, the bill would initially allow eligible New Yorkers up to 10 weeks off, which is a major expansion from the four days off that most employees currently receive from their employers, according to a 2018 survey by the Society for Human Resource Management.
    Bereavement leave could be used for the death of a spouse, domestic partner, child, stepchild, parent, parent-in-law, stepparent, grandparent or grandchild. It would not apply to a sibling.
    The council said the legislation was flawed as written, citing language that allowed bereavement leave to be taken anytime after the death of a family member, as opposed to in the immediate aftermath. It also said that employers wouldn't be able to plan ahead for the absence of an employee and believed it would be an "immense" challenge for small businesses.

    "We are particularly concerned that the Legislature is proposing a dramatic expansion of the Paid Family Leave act that has only been in effect for just over five months," the Business Council wrote in a legislative memorandum
    Starting this January, New Yorkers were able to take up to eight weeks off at half their average weekly wages to bond with a child, care for a family member or assist loved ones when a family member is sent abroad for military service. Time off and the benefits paid while on leave are scheduled to increase until 2021, when employees will have up to 12 weeks off at two-thirds their weekly wages. Any benefits would be capped at a percentage of the statewide average weekly wage.

    The program is funded by a 0.126 percent payroll deduction from an employee's weekly wages.

    The delay in implementing the bereavement leave benefit, according to Morelle, is to allow time for the state Department of Financial Services to calculate the cost of expanding the paid family leave program. He anticipated the program would remain affordable, despite the additional coverage costs.

    Full-time employees are eligible to take time off under the program after 26 consecutive weeks with their employer and part-time employees qualify after 175 days.

    It's taken out of every employees pay check. Family leave is handle by a private insurance company, The Hartford is one. Nice little gig for the insurance company. I'm sure no hands were greased in the process.

    I worked with a fellow whose grandparents died 6 times in 10 years . HR personal changed and he just kept turning it in . No doubt he will wish he had not squandered them all until 2 years from now .

    Stupid plan/idea.

    Should not be the employers responsibility to take care of an employee due to a death.

    That is why people need to actually save money and plan for these things.

    Death is a part of life, plan for it, deal with it and get passed it. On your own dime, not on the bank accounts of others.

    Many husband and wives are employed at the same business . This bill was introduced by Rich Funke a republican ... Where I work skeleton crew ... One person goes out we the rest of us works 60 hours per week to cover .. Sometimes more

    The state will take money out of the employees paycheck .. I heard maybe 1.60/week just like NY State disability. .. Then when you take the leave you get like 60 % of your wage . ... Check will be from the state insurance fund ... or something like it. ... I can see where this will be abused ...... The way it is set up one does not have to take the time all at the demise of the love one ... One can take the 10 weeks any time they want....

    As will ALL forms of welfare. I do not want to pay for others so they can cry over a natural event.

    I do not want the money of others.

    If you are not wise enough to save for rainy days, do not take the time off of work. The problems of others is not my responsibility and too be honest, I just do not care!

    They already do this. They are looking at expanding it. My mom passed away last month, and when I went to apply for this, the paperwork was so mind-boggling I said fuck it.

    They will make this fund go broke just like social security. I have a lot of problems with this. 10 weeks wow. I have 2 grandmas left so if in the same year they both died and I had a baby I could be off 32 weeks. Now I work for the state so my time would still accrue. So I could take 2-weeks off for vacation, a week for personal days, all My holidays, 2 floaters, and some sick time. So o could get 40 weeks off. That’s messed up.

    I also find it messed up that dudes get the same amount of time off as women for having babies.

    This is another reason many small businesses have flat out stopped hiring. Small businesses cannot handle excessive government-mandated minimum wages for unskilled employees, they cannot simply keep someone's "job open for them" if they take months off, and they cannot afford the employee "insurance" mandated for family leave.
