For every law there is a work around. Depending upon the local radio traffic you can listen live to radio traffic via your cell phone data minutes. No ham license needed. They going to ban apps? Alternately a base ham station could listen in and then text/call tow drivers thus alerting them.

I'd love to have a portable ham in my car/truck to listen into and avoid chaos out there, but in the eyes of the government we can't be trusted and are all criminals.

I don't know why this is even an issue anymore. A lot of the police departments have upgraded their radios to use encryption, and you can't listen in anymore as it is.

I use a cell phone and broadcastify to listen in the NYPD citywide frequency while driving. I can’t wait until I get the ticket — I’m going to show up in court and ask the officer to produce the “scanner” I allegedly listened to. When the iphone gets pulled out I am going to point out that 99.9% of New York drivers possess that while driving.

The most important thing to know on an iphone is to press the power button 5 times rapidly to disable touchID.

Courts have held you can be forced to unlock with your fingerprint, but cannot be forced to divulge your password.

Smart cops and the FBI know to put your phone in a faraday bag immediately so it can’t be wiped, but as far as we know password encryption is not capable of being cracked. At least not for a misdemeanor VTL case.

So what? This isn't a tow truck driver issue. And not all NYC tow truck drivers are perps. That statement is ridiculous. This affects Ham Radio licensed operators and people like me who take prepping seriously.

The case you referenced involved a scum bag accident chaser. I've had enough dealings with them over the years to state with authority that they're scumbags. I've probably dealt with far more of them over the years then the typical cop hater has dealt with cops. If they can do it, so can I.

Nothing. Just an analogy. We complain about Fudds yet some here have the "I've got mine" fudd attitude. Or the "I've got mine" because I have a badge attitude. Who cares as long as I can use my personal radio that my department doesn't really want me to have.

Well that's just a philosophic problem. That's not unique to governance. Try to define a chair, for instance. Does it need 4 legs? What about a rock, you can sit on a rock -- is a rock a chair? There will always be exceptions to the rule, and Socrates was quite fond of playing on the problem of definition during his time.

However, given the fact we live in a day and age where we have nearly unlimited digital space for documenting our laws, I don't see that as an excuse to not revise them. If a rule winds up having too many exceptions that it barely applies though, maybe it shouldn't be a rule?

A cell phone can’t receive signals on the frequencies used by police, they receive signals on much higher frequencies. So I think with the app you are probably good to go. Same with some guy simulcasting the cop radio over his CB radio.

Ok. Point taken. What about the word "Equip?" They are saying carrying a handheld is equipping. I cannot agree with that no matter what the intent of the original law was. A portable radio on your belt is not equipping it to your vehicle.
