Read. The article. It says while interviewing the driver, probable cause was established. This probable cause usually comes after a quote unquote odor of marijuana or the driver acting suspicious in the eyes of the officer that wants to conduct a fishing expedition rather than just issuing the traffic citation. I’m pretty sure no criminal except a dumb few will answer yes to a question of “May I search your vehicle?” when they were only pulled over for speeding.

That doesn't rule out consent. Only that consent was established. They could have said "sure go ahead". Established.

NYS is "Implied consent"... So end of story regardless of probable cause or justification! They were violating V&T law, and that gives cause enough. Wasn't like a roadblock or anything that swept up a driver out for a cruise and the officer wanted to search, that in my mind is entirely different! And 2 wrongs, don't make it right! If it's illegal, it's illegal. Don't do the crime if you can do the time! Lol
