One thing I liked about this situation is the concealed carrier didn’t just go for his gun. He used a surprisingly simple diversionary tactic to get the robber’s attention away from his girl. The second the robber turned his focus to the floor, the concealed carrier knew he had time to draw his gun.


The direct route isn’t always the best. Sometimes a simple trick to get the focus off of you is enough to get that momentary advantage you need to prevail in a gun fight.


One of the best lessons of this story.

Great story. But not to diminish from its great ending, what do you think would be the next thing that would happen should this have taken place in this great FUAC state of ours! Its stories like this that make me envious.

Could you imagine if it were me and I blew this turd's gut wide open, and to boot, his gun was't loaded. Courts would have a field day with this.

How and why would this incident be different in NY State?

There is NO evidence that the story would be that much different in NY.

Sorry, but just more made up shit about how bad it is here. Sure, things are wrong in NY, but listening to some, you would think we have no freedoms at all. We have no reason to protect our loved ones. For anyone who believes that this incident would be treated differently here, I would suggest you do some homework on our laws!

Article 35 generally permits use of deadly physical force if the threat of unlawful deadly physical force against you or another is imminent and you or others cannot reasonably be expected to retreat with complete safety. Notwithstanding the fact that the gun turned out to be unloaded, if a gun were held to my loved one's head during commission of a robbery, damn straight I would do what ever is necessary to stop the threat.

Maybe LEO's would agree that this was the correct thing to do as would I, but be ready to lose a life savings trying to do so. I can do all the homework I want, but that won't change the bullshit I need to go through to prove my right.

Why would you need to spend money to prove you are in the right? Ok, so when a scumbag shoves a gun in the face of your loved one, just comply to what he wants from you.

Sorry, not trying to sound like a dick, but it astounds me how many handgun owners have no clue of the laws that protect them.

Never said I would comply and not defend myself if anyone in my family had a gun pointed at them. I just merely said that if and when I did in this state of ours, I would not be expecting a pat on my back and hearing the courts say "you had every right to do what you did".

I know that I would be in for a rough time before I was cleared. I know the laws that protect me but I would have to prove them without a reasonable doubt which is the frustrating part.

Doc, I have been looking into this outfit for a while. Have not been able to speak to anyone about pro's and con's.
The first thing I did when I began CCW'ing was to make sure I had a good Lawyers name with me at all times. Folk's have no clue that your troubles begin when you pull that trigger whether you are in the right or not. Having a good lawyers name doesn't mean it can't bankrupt you.

In this state I still think it depends on the county. I can see some counties making an arrest and the DA refuse to prosecute, Arrested and the DA will prosecute, and some counties where no arrest is made until the DA reviews report, to a few counties where no arrest is made and the DA reads the report goes to the bathroom and washes his hands of the whole thing, both whole things. FUNY justice here.
