State Police arrest 5 vehicle occupants for being found in possession of a stolen handgun during a traffic stop in the city of Rochester.

Another article with no facts. I can see the driver being arrested if he didn't have a license. How did they get the others? Who had the gun? Were they dumb enough to leave it in plain sight? Nobody else needed to provide ID. Unless they were recognized and the cop knew there was a warrant they shouldn't have been arrested.

Unless it’s in possession of one of them, NY law considers it in the possession of all of them. My guess would be no one had it on their person, so they all get charged for the same gun.

Yet another BS law. This state is so far gone it's hard to believe.
Gun in a common area, nobody owns up to it - they all get the charge. Someone will start talking soon enough and the true possessor will be revealed.
Nothing wrong with police asking for your ID. It isn't any different than me asking you for the time. You can either give it to me or tell me to go buy a watch. It's up to you.
Lastly it said they were on probation/parole and there were active warrants. It's not unreasonable to think they were well known in the area by police.

All someone had to do is fess up. I also believe someone can make a sworn statement and it will belong to the accused. Otherwise all drugs and guns found in cars would belong to nobody and it would make the laws void.

The inability to enforce a law without violating someone's rights is *not* a justification to violate them.
If that means the law is a joke, then it's a joke.
It stands. Petition the court and lawmakers if you don’t agree. I can’t help you. I can only tell you what is.
