My understanding is that "suspicion" needs to be suspicion of a particular crime before they can stop someone to investigate. Just "unusual behavior" doesn't cut it.

Honestly they stretch this stuff so far it's like the 4th ammendment doesn't exist.

Most of the bill of rights has been sacrificed on the alter of "we can't enforce the law if you make us respect this stuff".

My answer on that is laws that you can't enforce without violating the constitution shouldn't be laws.

We let known murders go if their rights were violated in an attempt to convict them for a reason. It's because the rights are more important than putting that one criminal away, and if he doesn't have them, nobody does.

Didn’t read the article but we all profile. I do it everyday. Not much different. It’s a known drug and gang area so what do you expect.

I've been stopped walking from City of Newburgh toward Town of Newburgh and was told basically the same thing by the cop - and I'm a white guy. I must have forgotten my white privilege card that day. :idk:

I don't blame the cops though. Newburgh is a shithole. Not a lot of good comes out of there.

Newburgh gets a bad rap in many ways. It's actually a very large area and parts of it are quite nice (relatively speaking). A few square blocks in the city bring it all down though...

There are 2 parts of Newburgh - the city and town. The town is nice with a nice mix of rural and commercial areas.

City of Newburgh is a shithole with no redeeming value. Anything that should be nice in the city is spoiled by the corrupt city government. Most of it is a dump though.

The town of Newburgh is just like any surrounding town. You see American flags, real tree jackets and trucks, no trash on the streets, etc. You even see farms and tractors in certain parts.

Even the City of Newburgh isn’t all that bad. The Waterfront is great. It’s the 5 or 6 block radius in the center of the city of Newburgh that is the problem. That’s where all the welfare, drugs, and run down housing is mostly in.

"I was trying to avoid him," Kennedy, 27, said during an interview on Monday. "I was trying to get out of his way."

It was obvious to officer that the car was avoiding him, The car was coming from an area that is known to have a high density of drug abusers, One male in the front seat one in the back seat. So why was the driver avoiding the police? In this case it turned out to be nothing. But the actions of the driver were highly unusual, which caught the attention of the cop. He was acting in a manner consistent with someone who had an outstanding warrant. For all the cop knows there could be bodies in the trunk or 200 pounds of coke. But he'll never know , because he didn't have probable cause to search .
