John Durham Blasts Former Clinton Lawyer Sussmann’s Effort to Dismiss Case​


Special Counsel John Durham blasted Hillary Clinton’s campaign lawyer Michael Sussmann for trying to get the indictment dismissed.

Sussmann was indicted in September for lying to the FBI.


According to the indictment, Sussmann falsely told James Baker he wasn’t doing work “for any client” when he asked for a meeting with the FBI where he presented bogus evidence the Trump Tower was secretly communicating with Kremlin-tied Alfa Bank.
Sussmann’s lawyers absurdly argued that his false statement to the feds is protected under the First Amendment and made no impact on the FBI’s probe.

If I recall correctly Flynn was charged with lying to the FBI. That first amendment excuse didn't seem to work for him.

Better late than never. My guess the investigation stops at the hillary campaign and does not include the members of the obama administration that were involved. My fantasy would be to have hillary rat out obama for a reduced prison sentence but that's not going to happen.

In a filing in February, Sussman’s lawyers moved to dismiss the charge, claiming their client “did not make any false statement to the FBI” but even if he had, “the false statement alleged in the indictment is immaterial as a matter of law.”Allowing this case to go forward would risk criminalizing ordinary conduct, raise First Amendment concerns, dissuade honest citizens from coming forward with tips, and chill the advocacy of lawyers who interact with the government,” the filing stated. “The Special Counsel’s unprecedented and unlawful overreach should not be countenanced, and the single count against Mr. Sussmann should be dismissed.”

Judge blocks purported evidence of Clinton ties to plot linking Trump and Russia​

A federal judge has blocked special counsel John Durham from introducing evidence he contends will show former Hillary Clinton campaign attorney Michael Sussmann acted as part of a “joint venture” to taint former President Trump by linking him to Russia.

Prosecutors with Mr. Durham’s office had argued that Mr. Sussman, a Perkins Coie lawyer who represented the 2016 Clinton campaign, worked in concert with pro-Clinton operatives, tech researchers and others “toward a common goal” of promoting negative stories about Mr. Trump.


U.S. District Judge Christopher Cooper, who was appointed by former President Obama, said efforts to link Mr. Sussmann to a vast anti-Trump scheme would “essentially amount to a second trial” for conspiracy, a crime that has not been alleged.

What a stupid headline. You have to read the judge’s ruling yourself. Sussmann’s team got denied completely on 3 motions and had the fourth motion granted in part and denied in part. And what was granted, Durham can prove it in other ways and it doesn’t hurt his case against Sussmann. The judge himself say this in the ruling.

Durham has other ways to prove the conspiracy to the jury, as the judge says in his ruling.
