Well, that free's up Hunter to testify in what I hope will be many hearings and grand jury's without fear of prosecution for any involvement pre 12-02-24, and face new perjury and obstruction charges if he lies. I'm thinking Biden is going to do a shit ton of pardoning before he's term runs out.

And he can't claim the 5th in court anymore, since he can't incriminate himself for anything that happened that decade.

Yes he can. ....

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Nowhere does it say that the person gives up the ability to exercise this Right.

His "immunity" is only for Federal criminal charges. If he decides to "Plead the 5th", he still has this Right.

They strip people of their 5th ammendment rights by giving them immunity to prosecution all the time.

Once you cannot be prosecuted for a crime, then you can be forced to testify about it. You aren't incriminating yourself unless you could be prosecuted.

Now, it's true that he could claim that a state might still be able to prosecute him in some circumstances, but the federal immunity *does* eliminate his ability to plead the 5th in a *lot* of what he might be called to testify about.

The 5th doesn't say you can't be forced to testify at all, only that you can't be forced to incriminate yourself.

If the thing you are being asked to testify about can't possibly lead to charges against you, then you *can* be compelled to testify.

Normally the 5th gets you out of testifying aginst co-conspirators, but once you have immunity (whether you asked for it or not) that goes away.

Again, he only has this immunity on the Federal level. What ever he says can be used against him in State cases; if they pop up.

Your examples, while good ones, do not fit that tightly in his case.
