That charge can easily be beat via the
United States Court of Appeals 2nd Circuit's decision. It's a nullified law. It would be impossible to convict on it.

It sounds to me like you don't like the information being posted here and since you choose to carry 7 for your own reasons it bothers you that you do so you are taking it out on others and saying things that no one said.

No one is forcing you personally or anyone for that matter to carry 7. You can carry 5 rounds or none at all. It doesn't affect anyone here but yourself.

The court decisions are posted for anyone who wants to follow the actual law.

And what you have explained about the law is correct! But I think after your explanation you might say what I said do what you are comfortable with! It's just like carrying with a restricted license do what you are comfortable with!

I guess people should decide whether or not it's worth being arrested, going to jail over, and showing up to court to, and I guess ... wait for them to throw out the charges. :idk:

The police can charge you with whatever they want. The DA chooses if it's going to prosecute based on those charges. Afterwards the Grand Jury votes on if it was actually a crime based on the actual law read to them by the ADA and if the charges will go to trial. The defendant has the right to testify to the jury. After presenting the 2nd Circuit's decision, the Grand Jury will have to decide if they will ignore the 2nd Circuit's decision and take the case to trial.

It's very unlikely that they would ignore the 2nd Circuit's decision but if they did, the trial jury cannot.

A cop could just arrest you for murder. Or how about gun possession.

Now, you have a permit. You go to arraignment. The judge is shown your permit . No prima facia . Case dismissed. Same with the seven rounds. Now you sue. It’s no different than if a woman goes topless in the street where men can go topless. The NYS court of appeals court ruled it unconstitutional but the laws are still on the books.

Dems Biden and Persaud have quipped about civilians only needing 2 rounds for hunting or defense. Maybe limits of loading 2 rounds in any gun will be proposed and then revolvers are in play too.

6 (revolver) or 7+1 / 8+1 depends on the magazine. By the way the Albany Criminal pushed the unconstitutional UNSAFE Act through in the middle of the night hiding it from We The People.

Dollars to donuts says that the DA drops those charges that the cop illegally charged them with as add ons because you can't legally convict someone on a law that has been striken by a Federal Circuit Court.
