If you get denied, get a lawyer.

They do not want to have to defend such a denial in court. If they continued it would eventually end the "may issue" system because it is so obviously illegal.

Most likely they would just "change their mind" once they found they would have to defend it. That alone is proof of the arbitrary nature IMHO.

From what you posted, I don't think they'll deny you.

I know of people with several convictions under their belts who have permits.

Well, that makes me feel a bit better. My sister should be getting hers any day now. She was interviewed by the sheriff's department in November I think.

Some counties, or more municipalities within some counties, go beyond a criminal background check and want you to friend them on FB so they can look at everything you've posted. As far as I know some cities within Albany county are like that. Messed up.

The PPO does have it and they said they won't send it on to the judge for 2-3 months, but I should expect to see it in the mail in 3 months or so. Umm. Sure.

Who knows... By then, perhaps SCOTUS will have agreed to hear Peruta v CA (they had a conference that included it today, and we might hear if they agree to grant Cert on Monday...). Of course, if they do, and rule that May Issue is not allowable, then the whole system in CA and NY and a few other states might go away. And then, how would they still justify taking 12-18 months for permits???

More likely though, is that you will hear long before that could even be a remote possibility...

Do people without felony convictions, restraining orders, and/or those who haven’t had any documented issues with depression get denied for a CCP? I’m asking because I just didn’t get a good vibe (whatever that’s worth) from the police chief who did my face to face interview.

Here’s a few reasons I’m a bit worried that I may be denied. First, and he started the interview off by saying “Let’s start with the elephant in the room”. I’m a junior, and my dad has a pretty egregious felony conviction from 25 years ago. Shouldn’t have anything to do with me, but it’s a strike. Next, I included my shoplifting arrest from 27 (I was 15) years ago for which there was no record, but I got the disposition letter for it. When I was telling him about it, I laughed a bit, not cuz I thought it was funny, but because of how stupid I was to do it and that I was embarrassed. I’m not sure he got it though, and wrote something down at that point. Great. I’ve had no issues since then, except 2 speeding tickets more than a decade ago. Then he asked me why only one of my references lived in our town. Well, for at least 20 of the 32 years I’ve known them, 3 of the 4 did live in town. Lastly, he asked when the last interaction with the police was. I told him it was when my wife had a panic attack and was taken to the hospital overnight. She’s needed nor received anything for it after that. Sometime during the interview he stated that the 2nd doesn’t guarantee anything and that the judge makes the final decision, but he only makes a recommendation. Seemed like he was deferring blame if I were to be denied. Sorry for the long post, but am I overanalyzing, or am I screwed? It’s been killing me since my interview.

20 months! Hell, - I think you might be the record holder on this forum with that.

In your case, you like many others were still restricted from receiving your rights for an extended amount of time, almost two years. I believe by choice, not because of there being a "record amount of applicants" or something else they like to throw out a lot. They can get away with delaying the process intentionally and they do it all the time. It should take a week or a month at the very most to get one in the mail. Nearly two years is outrageous, but I remember the feeling because I was delayed my right as well. Disgusting, really.

Yeah. It took so long cuz West Seneca sat on it for over ten months if I remember correctly. I only applied for hunting and target as the instructor recommended. My sister didn't follow his recommendation and got unrestricted of course.
