Not really a grey area, just people confused by weird ATF regs. Those holsters are legal, without an AOW tax stamp, because the firearm is partially exposed. You can see the slide. There have been other 'wallet holsters' that more completely mask that it's a firearm (but still allow it to be fired) and those can be an AOW.

The good news is that although LEO's are notorious for minimal knowledge of firearm arcania (like 99% of average citizens), a Wallet Holster is unlikely to raise an eyebrow.
The bad news is that anytime a LEO is involved in a situation where they are observing your handgun, it's probably trouble for you.

A friend I worked with back in the 80's had a holster like that for a .25,think it was a Baretta,but not sure.Anyways,he shot himself in the ass.Thats all I got
As an example, think of those briefcases that used to be made that could house an MP5 that was capable of being fired while inside it. That falls under the same AOW status that a fully enclosed wallet holster would. I remember seeing them many years ago. They were a fully enclosing 'wallet' (strapped over the slide) where only one side was open to access the trigger, so from the other side it looked like a plain fat wallet.

Not sure what the point is in a pocket holster that doesn't cover the trigger.
Isn't the purpose of a holster to protect the trigger and secure the firearm ?

Other than reducing a print, absolutely nothing. A gun that small doesn’t need to be reduced in printing unless you wear pants that are too tight. And if you do, you’ll have a hard time pulling it out.

so a hoodie pocket should be a AOW holster too ??
To be clear, I wouldn't use or endorse these kinds of holsters either, but there is a point and it isn't to reduce print. They're intended to keep the gun appropriately aligned in a pants pocket to be drawn more easily; rather than shifting around and potentially not being vertically straight.
Hey I simply stated the ATF's stance on this and answered the question at hand. I certainly never said anything about the ATF was sensible or reasonable.
