“Seller of ammunition” is any person, firm or corporate entity engaging in the business of purchasing, selling, or keeping ammunition, but this does not apply to private sellers (N.Y. Penal Law §§ 265.00(24)). If ammunition sellers are not already licensed firearm dealers in the state of New York, they must register with local police.
A licensed dealer in firearms or registered seller of ammunition must be the intermediary between the transferor and the ultimate transferee in all commercial sales of ammunition (N.Y. Penal Law § 400.03(7)). Physical transfer of ammunition must be in person. (N.Y. Penal Law § 400.03(7)).
he seller conducts a check with the state’s electronic database and, receives a number identifying the transaction and signifying that the transferee is not prohibited by law from possessing the firearm or ammunition.

All of NYS pistol permits are now 3 yrs. They have been since the second cycle of renewals. It’s no sweat bud. Sell your ammo as you feel comfortable. We’re All just trying to let you know that neither you nor the buyer have to go through an FFL for a private sale. Period. You do you , all’s good.That link is old and wrong.

Valid point. I should have stated that at least if the have a pistol permit, then they’re good to go. It still shouldn’t even come down to that though. A background check is only required if the seller is engaged in the business.What if they don’t own a handgun?

I know, I couldn't find any NYS stature on ammo sales but all point to ammo being transferred through an FFL.Anyone who sells ammo needs to be a registered seller of ammo. Engaging in the business of selling ammo doesn’t mean you do it weekly. NYS business law basically says anytime you sell something you’re engaging in the business of selling. It’s a trap because you need to look at and understand the business side of the law and apply it here. This is why there is no volume number or dollar figure assigned to this law. Also the guy who sold a few boxes of ammo at his bait shop needed to register as a seller of ammo.
Think of it as if you sell a used something or other on Facebook marketplace or eBay you’re supposed to report that as income. No one does.
