If the firearm they had pictured was the one he used, as per the New York State definition its an assault rifle, weather it was registered or not is a different story. his action are not defendable and he should not have access to firearms or weapons. Weather its was a sporting rifle,hunting rifle,target rifle,assault rifle defense rifle ,what ever you want to call it these are the people who make poor decisions and should not be allowed to continue to own a rifle

No. According to Gov. Monkeyface and his cronies, it is an "assault weapon." There is an actual definition of an "assault rifle." An assault weapon, however, is merely a political construct intended to scare the ignorant.
