I wonder what would have happened if he kept recording, EVERYONE knows he was perfectly legal, I think the law suite would be exponentially higher if they would have arrested him.
I wouldve kept recording, arrest be damned. You're on my property with officers who I bet are recording themselves. If this "judge" 1. either knowingly told him recording was illegal or B. didnt know the law regarding recording, she should be immediately removed from the bench.
Her answer of "oh yeah I will" tells me she has no legal backing to what she's about to do. If she had a legal explanation for her actions, she'd have been wise to provide it.
I'm not a lawyer but I dont know if I've ever heard of a judge actually appearing at someone's home like this. I don't even know where the legality of this even comes in.
The fact that this involved a divorce makes me all the more suspect this has more to it.
I'm confused ... W.Va is single party consent state, so no, the recording is not stopping! Second, NO Warrant, then get off the property, don't care who your are! 3rd, notification that I will ignore any unlawful order, so make sure you know what you're doing! Now you're trespassing! Leave immediately!
