What dealer? This a direct transaction between the consumer and the manufacturer. The dealer does not offer any warranty, the manufacturer does. You already completed a 4473 for the original gun. It broke and it is under manufacturer warranty. The FEDERAL GOVERNMENT allows for this relationship to exist. You can send a lawfully purchased gun back to the manufacturer for repair. They, in turn, can send YOU DIRECTLY back a repaired or REPLACEMENT gun. It's pretty fucking clear.How would the dealer account for the firearm in question? Do they have to enter it into their books at any point in this process?
I guess it depends on where Ruger sends the rifle. Which depends on how it was sent in the first place. I know that I have a great deal of difficulty even finding a shipper to accept a firearm or even parts in the first place. All the Fed Ex and UPS facilities local to me won't accept firearms from a private individual even if company guidelines allow it. I have to ship via an FFL regardless, which means that is probably where the manufacturer will send back to. Which means if a new serial # is involved I will have to do a 4473 again. Paranoia in the gun community often trumps the letter of the law like it or not. When I bought my Galil the private seller insisted on going through an FFL for a NICS check even though he had no obligation to do so. Therefore I would still advise @Depick if the rifle in question was replaced, if he shipped it via an FFL in the first place and/or if Ruger ships the replacement rifle (with new serial) back to an FFL he will likely have to do a new 4473. I suspect however he will not be getting an all new gun though. They probably just replaced the barrel, or maybe honed out whatever bur(s) were causing the problem. No I wouldn't. We don't know what the shipping situation with @Depicks gun is though. Depends on how he shipped it in the first place. If the gun is shipped to an ffl then the ffl must do a 4473.
If the gun is shipped BACK to the individual directly no new 4473 is needed. (They will provide a receipt with what they did with serial numbers on it so you have proof, should you need it. Obviously the manufacturer will also always be able to pull that info up. ). This applies to a replacement firearm or a repaired firearm.
And as I said, despite my acceptance of what you have said, I still had to do a 4473 on my replacement Daniel Defense, which was shipped from and back to my local FFL. I have no difficulty in accepting that this was unnecessary but I still had to do it. Obviously if no FFL is involved no 4473 would be either and I never said that.
