I had a discussion with my wife the other day about this. We agreed that if the financial situation changed next year, significantly, we'd seriously consider moving over the border to PA. So whether we move or not is in Cuomo's hands. It makes no difference to me where I work, since I wasn't commuting before this happened.
So it's really up to Cuomo. I'm not as trapped as I used to be. I could afford the move. Painful, but I could do it.

This would give SOOOO MANY people in NY a shot at getting out. NY would try to find a way to prevent full remote work options. Maybe require one day a week onsite by executive order, which, sadly many people/companies would follow. My company has a HUGE HQ in another state, 1,000's of employees, all but security and absolutely critical staff allowed on campus, and it has been closed since March. I am sure they have been looking at down sizing physical work space. NY will find a way to tax people, even if it is illegal.I keep wondering if my department will ultimately go to 100% remote work if you want to, at least for certain offices in high rent cities. It wouldn't surprise me, long term leases notwothstanding I know the firm is looking at the issue ("why do we pay so much for so much real estate?")

I don't think they could get away with any kind of an order like that. Regardless of the other stuff they've gotten away with. It's a far cry from "you are NOT allowed to be at X location" to "you MUST be at X location."
What they will do is make the exit tax so punitive that it won't be worth it for most people to move away.
How would an exit tax even be enforced? Yeah, you couldn't come back to NY, but how would NY enforce an exit tax for people who moved to other states?
A NY state exit tax isn't enforceable once you're out of NY. Maybe against your assets in NY, but once you're out of NY they have no control over you.
