Legality of Slidefire stocks in N.Y

Just bringing this up because I have sold slidefire stocks in the past just none in New York. I have had a few customers since this happened trying to buy them from me in N.Y and I'm not entirely sure they are even legal here. Something I never thought about before.

Here is the excerpt in the law.

S 265.02 Criminal possession of a weapon in the third degree.

(2) Such person possesses any explosive or incendiary bomb, bombshell,
firearm silencer, machine-gun or any other firearm or weapon simulating
a machine-gun and which is adaptable for such use; or

just food for thought because the atf response to the vegas incident clearly said while not full auto the slidefire stock does simulate full auto.

This probably also rules out the binary triggers etc.

Not sure about the binary trigger but all of the slide fire stocks I've seen have pistol grips so that would be a no go right there.

if you are depress the trigger and hold it, and rounds keep flying out, its full auto..
if you must depress the trigger and 1 round comes out each time the trigger is pulled, its semi auto. The bump fire slide stock just uses the recoil of the weapon to make shots faster.The front of the weapon recoils into the stock,not very accurate either. It is not full auto,doesnt meet definition of full auto. When you buy one,it comes with a letter from the BATF that says its federally legal. You don't even need a stock to bump fire. Any semi auto can be bump fired. I'm not here how to tell someone how its done, but the stock is not necessary to bump fire a semi auto rifle...
It is also not very easy to make it bump fire,even with the slide fire stock.My guess is that looser had a lot of practice bump firing,as in the tape it sounds very consistent. Still no where near the fire rate of full auto,but effective non the less. Thanks to this idiot,all the law abiders will be targeted as usual. this is digusting how someone could take human life like this.To take something meant for sporting purposes and do this horrific act is truly horrible.

Not saying it is a good set up though. But similarly, I believe the mean arms website does show the MA loader being used with a full auto gun without taking the mag out.

From the Inrange tv video on the shtf SAW concept it looks like its easier if you have something with give and spring to push against like a bipod with long legs or maby (I'm thinking of the vegas case) a cushion or something aginst the window sill?

They are legal in NYS. They didn't want (still don't) semi automatic versions of fully automatic firearms I guess is what that applies to, which is kind of not really enforced much anyways by itself if it meets the other criteria. A great amount of firearms in NYS can be converted to fire fully automatic either way. That isn't being enforced much by anyone other than the ATF on the federal level anyways since open bolt firearms were banned from what I can tell. The brand name alone can be the difference between an illegal gun in NYS and a legal one. If the bump fire stocks aren't an NFA item and just considered a stock, then it's simply not regulated or illegal to have or use or sell.

1. What ATF says on the subject is irrelevant
2. NY courts have never interpreted the "weapon simulating a machine-gun and which is adaptable for such use" portion of Article 265 and there is a decent risk one of our many anti-RKBA prosecutors in the state would go after a bump stock on that basis.

YMMV.

Simulating a machine gun are the key words. You don't need interpretation of them through case law to get charged. With that said, it only applies if installed. By itself, it doesn't stimulate anything. It's just a stock that moves.

OP. At the end of the day, the hassle isn't worth it if you can sell out of state unless the few dollars you make are needed desperately.

Even though you'll win, you could lose money explaining yourself if one of Andy's goons are making the purchase to demonstrate how easy it is to get.

Let the manufacturers and bigger dealers deal with that. Their pockets are larger than yours and they have attorneys on payroll.

I see this is just another bit of ice on the proverbial slippery slope.

This is the logic I see the Left using to hoodwink an ignorant public:
  1. We have banned machine guns.
  2. So, we should ban accessories that can allow semi-automatic rifles fire as fast as machine guns.
  3. Later: People seem to still to be able to bump fire without banned accessories. So, we need to ban semi-automatic rifles.
  4. Later: People seem to be able to fire too fast from bolt-action rifles that have magazines. So, we need to ban rifles with removable magazines.
  5. Later: People can still fire too fast, and reload fixed magazines too quickly with stripper clips. So, we need to ban all rifles that have magazines.
  6. Later: Statistics show that even though all magazine-fed rifles have been banned gun homicides remain unacceptably high. Handguns seem to be the real problem. So, we need to ban all semi-automatic firearms.
  7. Later: We still see too many gun deaths with the remaining pistols. We need to ban all pistols.

If such a slide into stupidity is allowed to occur, we'll be lucky if we're allowed to keep break-action shotguns.

My motto: Not one more inch. Not one more infringement.
