First off according to Bruen, it's not an illegal handgun. In NYS eyes it's an "undocumented" gun.

Secondly, the story is vague... was it sticking out or was it just a print?

Lastly, if there was no intent of harm, menacing or anything of that nature, then it should be dropped.

No victim, no crime, and likely no probable cause other than the observations of an "intelligence unit" what ever the fuck that is... back in the day they called 'em snitches.
