I wasn't sure, especially the way courts can be. To me, you bet, even hands alone can be deadly, as in the case of the guy punched in the head who then fell and struck the curb, causing his death. That was in Utica, I think. The "kid" got probation. Any violence against your person could result in death, so yea, I would say a skateboard is deadly. Curious to see if the courts agree.Wouldn't anything that could cause great bodily harm or death be considered a deadly weapon?
Baseball bat, hammers, all included amongst the FBI statistics in homicides. I think a skateboard could be construed as a deadly weapon along with a pool cue.

I believe justification falls within " what a reasonable person believes is an imminent threat of serious bodily harm or death ". Took a handgun class in Rochester taught by a former Sheriff. He stated that in NY case law serious bodily harm is an injury that may require 6 months or longer to recover from as the legal basis of the threshold. That means, by definition , even broken bones wouldn't constitute the use of deadly force. Additionally, "what a reasonable person believes" also includes a jury of 12 who would need similar views. I am not an attorney, but this was what was told to me. Can a skateboard cause serious bodily harm? Metal trucks, swung and making contact with someone's head? During his flight, he was surrounded by the crowd during his attempts to flee on foot and fell in the street. This is when the second shooting occurred. If true, the level of threat never decreases in his scenario, therefore all may be justified, just terrible for him.I wonder how much time passed between the first guy being shot and these other two. If it is any significant time (over a few minutes) the fear for your life defense is not likely to work. If you were afraid for your life to the point where you already had to shoot someone, why are you still in the area? That won't hold water. If you're afraid you're running for your life to get out of there. Not hanging around in the streets.

Although the video quality is admittedly poor, it appears to show the shooter point the gun up in the air and fire a warning shot, which does not deter his would-be pursuer at all. The pursuer and the gunman both disappear around the corner of a car, whereupon several more gunshots can be heard, presumably one of which hit the pursuer in the head.

I would'nt even prosecute if I was the DA. The kid will get off.

If the shooting was justified there cannot be a murder charge/ conviction. Want to split hairs and charge you for possessing the pistol? Highly unlikely. It was an emergency life or death situation.
