Unclear whether or not he had a truck, but it seems like this could be a "damned if you do, damned if you don't" situation. He ran out of fuel, and if he didn't have a trunk to lock the gun into, then his choices were to either leave it there, or walk all the way to (wherever he went) while carrying a long gun, which could freak out the ninnies.

Hmmmmnnn. Still strikes me as kind of chicken shit by the cops. Now, - was he drinking, and crashed and then bailed off the scene to avoid a DUI? Maybe...
But it makes me ask the question: if I am legally carrying my loaded EDC in my car, and am in a crash where I am injured and hauled off by an ambulance, - and my EDC ends up on the floorboard, would I potentially be facing this same charge?

It's a bone headed thing to do, but it shouldn't be the basis of a criminal charge.
Similarly, this guy make be a POS based on some of the other suggestions in this thread. But he wasn't charged for being a POS.
Maybe he was drunk, but he wasn't charged for being drunk.
This whole attitude of "well, he was doing this bad thing that we couldn't catch him for, so we made up these charges for something else to get him on" is disgusting.

If I "ran out of gas" before or after running my truck into a ditch and had to walk home or to wherever, would I leave my .22 rifle + 500 rounds of ammo in plain sight, out in the open? Fuck no, I would not. Who here would do that... probably no one here. That's a stupid thing to do. Is it reason for an arrest?... not a law guy so I don't know if it is or not, but there should be some consequences for STUPID.

Storing under or behind the seat is not always an option. I have a Ram crewcab pickup, there is no place to store a long gun out of sight. I am betting he didnt know or didnt think it was going to be an issue, as it should be.

Glad I live in an area where people wouldn't freak out to see a person walking down the side of the road carrying a gun. Just don't wear a ski mask at the same time and there shouldn't be a problem.
When I was a young teenager there would be 3 or 4 of us (friends) walking down the side of the road going to our shooting spot and all of us carrying our long guns. Nobody thought anything of it. But that was in farm country and in a different era. Most people had gun racks in their truck back then. I might be getting off-topic, so, over and out.

Last I remember reading, there was no clause in the 2nd where it states "unless STUPID, in which case this doesn't apply".
This is one of the reasons I'm leaving this fking state - so many here think they are smart because they know the intimate details of the guns laws, and he haw when someone not as "smart" as them gets jacked by the system. I don't know this "stupid" guy at all, and for all I know he cuuld be a real douche, but that doesn't matter. The state police could have easily run the vin, looked him up, called him or drove to his residence to bring him back to the vehicle to safety get his rifle and be done with it. Instead, gun charge here we go.

All well and good but the thing is, most gun owners in NYS realize the law will fuk with you if/when the opportunity arises, regardless of the 2A. So yeah, the guy was stupid for leaving the gun and ammo in plain sight when he left the vehicle. It left the window of opportunity open for the assholes to fuk with him.
This charge will LIKELY be dismissed in the interest of justice.....extenuating circumstances/non violent crime..and not an AR15.
