The very essence of even Surveillance of a person for non-criminal activity we all know the courts have disallowed! And the bracket placed for possible suspicion of non-criminal activity is just absurd.

If course though, if the "it's for xxx safety sake" rule is applied, all the above means absolutely nothing in this day & age! After a decade or two in courts, everything will get cleared up and a few dollars in my pocket, or to my estate!

You are describing how it should work.

In reality, more legislation is now created "from the bench" than by the legislature.

These people with ankle monitors will all have some judge's order to wear them, and judges can order anything they want and get away with it anymore.

Cut it off and they will issue a bench warrant for contempt. The cops will "follow orders" and arrest you for the "outstanding warrant" without caring one bit what the underlying order was.

If a person knowingly infects another with HIV they will be charged with a crime.

If you have the cold and go out and infect others with your cold, you're fine (it's common, most people do fine, etc). If you have some zombie like 100% fatality disease and go out and infect a bunch of people, you would (and should) be charged with a crime.

I'll leave it up to you guys to decide exactly how fatal a disease needs to be to qualify as something that warrants criminal behavior when wantonly and recklessly spread.

I said no such thing about HIV. Critically, it's very unlikely you'll get it from somebody except through intimate exposure.

So I'll ask again, hypothetically I have an extremely infectious disease, which is airborne, and has a 100% fatality rate. Should I be allowed to go around in public, or should measures be put in place to limit my movement?

The obvious answers to my questions are no, and yes. So now the only thing to figure out (granted it's easier said than done) is where on the spectrum of my hypothetical super-fatal disease and the common cold (trivial) we need to institute movement restrictions on people.

That it's in these so called "emergency" or "necessity" events, that the Gov't is taking liberties to extreme extension, expanding their power with the full complicity and compliance of the masses.

We have an obligation as a society to act in a manner that is civil to one another, of course. We the people though, grant powers to the government to provide services and effectuate the laws which our representatives enact. We the people, do not need the Government to "RULE" over us though, for our own good. There is a difference!

I will never agree that the government has any power not explicitly granted to it, and anything not specifically given to, it is null and void, regardless of the Judicial activism or Legislative overreach and Executive autocrats want to think they have!...
