Not sure how "you can have them but not on your permit". Sounds like he was being facetious with you. How would you take possession of an unregistered pistol? People are convicted of felonies every day. What's one more? Go for it!
Because my county is different. After making the sale I’d have to bring the pistol in for the county to inspect it. Now with COVID things change but before this was the way. After every purchase you have to bring it in the licensing office.
You take an unregistered gun to your judge for him to look over and decide based on it's appearance if it should be allowed? The penal law says you cannot possess that pistol if not recorded on your license. Sounds like a setup to me. Bizarre!
I agree with you 100% I’m not trying to argue nor debate that at all. The officer literally said it word for word “You can have it but we won’t put it on your permit” exactly like that. I’m no lawyer nor mathematician but even I know that doesn’t add up. Fuck it imma call a few FFL’s and see if they’ll transfer the pistol and let the licensing officer put the amendment on my permit.
The FFL will have to cancel the sale or if ordered it will have to be returned to original seller.So you want him to buy it and try to get it put on his permit "like normal."

There’s a unspoken rule and some FFL’s say it too. Suffolk will not put AR pistols, hunting pistols on your permit. Just HANDGUNS. I think that’s BS if my firearm is classified as a pistol and NYS compliant why are you restricting it?
This is from the judge directly? Not a clerk or office worker? If so you don't have a leg to stand on unfortunately. They issued it and you have to go along with their terms. Just like restrictions. Do you have a friend in LE who can talk to the judge for you? If not I'm afraid I cannot see a path forward for you.

A police officer is not your licensing officer I am quite certain. Unless they named a police officer as the licensing officer. It is usually a judge. It will be one specific person maybe 2. Everyone is not the licensing officer.
I am willing if it’ll help those who also want the same freedoms the rest of the state can get. There was an FFL who also said they’ll help me in the law suit. It will cost money and I would appreciate to know how much it would cost before I file a law suit.

They have broad authority over the license. I have shown where licenses have been denied for being rude to office staff. I’m not sure this is a battle you want to fight. It is not likely to end well. If you don’t like the limitations (restrictions) of the license it can easily be revoked. He is free to proceed as he wishes however. I wish him nothing but luck. They just aren’t scared of some random guy pounding his chest making threats.
Well 500+ people applied for their permits just this month alone once they realized it’s nothing but a on premise - to the range pistol permit and that people upstate have full carry, that’ll leave a bad taste in peoples mouth.
