3 Upstate NY students arrested for ‘horrifying’ mock shooting videos

Three Upstate New York students face felony charges of making a terroristic threat for posting online two brief videos where they act out a school shooting in someone’s house.

Civil rights experts on Monday raised First Amendment issues and called the arrests police overreach since the videos don't make any specific threat against any person or place.

As for constitutional protection of artistic expression, Apple said, "There's been enough shootings going on around the country. This is despicable artistic expression, if that's what it was."

Apple said the three students charged with felonies are being treated as juveniles in family court. A fourth student, who shot the video, was referred to the probation department.

So, it leaves me wondering - was there an actual thorough investigation to determine if there was an actual threat made. If there were no guns found, no ammo found, no plans for an actual school shooting or racial shooting found, just a sophomoric video with no specific threat - what the hell is the law enforcement officer talking about when he said what he said about when they take no action and then there is a school shooting. So, because it mentioned hating school, that rules out the collection of other pertinent evidence that would normally be required for an arrest - is that what he is saying? If there is no such evidence other than the videos and a toy gun, I anticipate a mega-settlement will be reached resulting in this children getting rich.

Based on what I read above it's much ado about nothing. Everybody in this thread has done stupid shit in the past, but we were lucky enough that we couldn't post it to instagram.

I real feel sorry for a lot of kids and in particular for those who do not have parents who guide them and constantly warn them about this (I do with my kids). Social media is a cancer on children. They should not be on it.

Way to make sure these kids never try to do anything creative ever again. Next time they'll know better and will play with their phones, do drugs, or whatever is acceptable for kids to do now.

He basically publicly said they are bad kids and he doesn't care if he's wrong, he had to do something and he did the right thing. "This is despicable artistic expression, if that's what it was."

There are better ways to teach a lesson than this kind of bullying. Parents doing their job would be a start.

Even if this gets turned over, this incident may stay with these kids.
When going for a pistol permit they want to know ALL arrests. Even youthful offender, not guilty or dropped.
I sure would not want this sheriff making decisions that could affect my saftey or freedom.
People in that county should be angry.

don't you worry, a liberal judge will dismiss any law suit filed, claiming the arrests was for the good of the community and too teach these kids a lesson
