37mm Flare Launcher transfer

Looking to transfer in one of those standalone launchers that require a FFL to come in as a "reciever". Called a few of my local FFLs (downstate) and they're not 100% on it. Anyone know any FFLs that would be willing to transfer one in?

Hmm. Not in that area but if it doesn’t have a serial number on it they may take issue with it and not transfer it. They may consider it a ghost gun these days or possibly an other. I’m honestly not sure. Proceed with caution as many laws just changed and I wouldn’t want you to get jammed up.
Hopefully some one with more knowledge in this area will chime in

My understanding is that actual flare launchers don't even need an FFL. They're like the ones you buy in the boating section of Walmart. Not even a gun.

If they *do* need an FFL, they may not qualify as flate launchers, they might be NFA.

I don't think there is a category of "larger than 50 cal, not a shotgun, but not a DD".

You don't need an FFL for one. They are 100% legal although I believe NYS -may- have provisions against it. NYPD specifically states they are no good in NYC, but again it's an administrative code that defines it.

Technically even M203s are legal because it's the round that determines its legality. For example, if you own the launcher with HE rounds then you would need a class 3 destructive license.

In PA you can buy a 37mm launcher and have it shipped to your home. You can also buy an array of non lethal shells like bird bang, smoke, flare, and firework.

Be careful even in 2A friendly states, if you buy shotshell adapters or a beehive/hornets nest it becomes a destructive device which violates the NFA.

37mm is a flare gun (assuming you don't have any prohibited rounds with it).

40mm is a DD even with no ammo.

Any explosive ammo for either ("bird bombs" excepted) is *itself* a DD that requires a $200 tax and registration per round.

But the 37mm will become a DD with even inert rounds present if they are considered "anti-personnel" rounds. Even non-lethal ones like pepper balls or bean bags. If they're not meant for signaling or line throwing or the like, then it makes the launcher it's near NFA.
