Wow this would be a disaster. These mental health checks are super opinion based and highly subjective. Any DR against guns would just say no guns. Then not only would you not be able to purchase the new gun but you would lose all of your other guns and future gun rights.

Oh, that's easy ! The "professional" you will have to interview with will be hand picked and appointed by El Duce. (S)He is NOTa doctor. Probably doesn't have any psychological training. May not have graduated high school. The only requirement will be to get a rise out of you during the interview ( which will by videotaped for evidence ) to prove to a judge that you are a threat to society. Then, Red Flag request is rubber stamped and you get a no-knock visit at 3:45 am a few days later.

I am a registered Democratic voter in Onondaga county and I would like to know your position on assembly bill A-1589A / S-7065. This is regarding the requirement of a NYS approved mental health examination by a NYS approved doctor following a NYS approved form / questionnaire in an approved NYS location prior to purchasing a firearm. I find this proposed legislation an egregious infringement to the rights provided me by the Constitution of the United States. For you to support this legislation would demonstrate you lack of concern for the law abiding citizens in your district. This is not about public safety we do not have blood running in the streets of New York. This is about downstate legislators trying to earn political credibility by exerting more control over law abiding citizens.
So please tell me where the criminals or gang members will be interviewed. Oh that is right you know that criminals and gang members will not pay any attention to this ridiculous legislation. Therefore it will ONLY impact law abiding citizens. If you support this legislation will all New Yorkers be subject to it? Will you fall under it or will judges or law enforcement how about the governor? Shouldn't we extend this legislation to educators? Wouldn’t it be beneficial to know if an educator harbored deviant thoughts prior to be hired? Or will you carve out special exemption to further divide New Yorkers. We already know that the criminals will be exempt.
The notion that citizens of the United States of America must comply with the order to be subjected to a state devised mental health examination to exercise their constitutional rights is repugnant!! What will be next a mental health exam in order to register to vote? Who would decide this? Oh sorry I know that answer it will be a New York State approved doctor who is a member of the majority political party. Then of course the next step will be to apply this type of legislation to the First Amendment because people must be crazy if they criticize state government. You know this usurpation of rights will not stop.
The governor says people leaving New York State, because of harsh weather. I say they are fleeing because of subjugating legislation such as this. The Democrat party own the problems of New York State poverty, high taxes, residents leaving, failing infrastructure, lack of employment, crime, reduction in federal representation and funding have all been created by the Democrat party and Governor Cuomo. So how do you try to correct these problems? You propose legislation to further dominate the lives of the remaining residents and drive them out. Is this legislation part of Governor Cuomo's philosophy that conservatives have no place in New York? What is your opinion of his remarks regarding this?

Presently, to be bestowed with a pistol permit in NYS, the applicant must submit to and pass a "mental health" check, and a county judge must review and approve the application, among other things. I have no idea how a mental health check is done.
I believe that a county judge has judicial immunity and therefore the judge could not be sued by a victim of a firearm related if a legal pistol permit holder is found guilty of such a crime. Therefore, judges can safely approve pistol permits having done their due diligence in reviewing the application for a pistol permit .
However, if this proposed bill becomes law, would the "mental health professional" assessing the would be purchaser of any long gun or hand gun likewise have some sort of legal immunity from tort law?
If there is no immunity, I would think that a mental health professional would not approve anyone for the purchase of a long gun or hand gun, and therefore the mental health professional avoids exposing themselves to the potential for a lawsuit.
With this scenario, no one would be approved to buy a long gun nor hand gun.
