I would not want to be an officer in NY attempting to explain why he shot some non-violent guy who was running away in the back.

The guy might have a grandmother with a dark enough complexion that you'll be fucked.

You really can't say that unless there is quite a bit more detail. I can think of a few reasons why you would and why you wouldn't. Its all circumstantial
