A poll from NY Senator Fred Akshar re: social media searches

Freshman NYS Senator and former Broome County Undersheriff Fred Akshar has posted a poll on his official Senate page about support for the bill regarding social media history searches.

Might be worth the couple of minutes to hit it.

In the area on why the law should be opposed:
There are three primary reasons:

Answer to question #2)
This is a violation of first amendment rights, I will start with that before anything. The ACLU will have issues with this hands down.
Next issue would be giving a password or passwords to a government agency. No one wants to do that and it is a blatant invasion of privacy.
Next let's talk about how this only effects legal gun owners. Those gun owners being the most vetted people in the state, Pistol permit holders. It is a very hard and long process in most counties to get a pistol permit in New York State. Paperwork, references, interviews and background checks from FBI and State Police.
Next let's talk about how the real crazy people don't use Facebook, Twitter, Instagram and cover their tracks while searching around the internet.
What about people who don't use or don't have social media accounts at all?

Now how about being able to actually implement this? Who is goign to fund the State Police and assign an investigator to look at social media and internet searches eight or more hours a day?

The last thing i will say is that from a technical stand point a user doing internet searches can clear their browser history or use browsers that don't track their history. In that case one has to think about how to get a browser history for one year? This would require Google, Yahoo and Microsoft to release information they might have and that is going to be a subpoena for each person's record to each company. How much time and money is that goign to tie up in the court system?

This is just plain wrong and not thought out. This was bill was written by someone who doesn't know how the courts handle permit applications, background checks, social media and browser histories work. This is unrealistic and all it will accomplish is making the backlog for new permit applications even longer and further infringe on the most vetted legal gun owners in the sate.

Answer to question #4)
The whole bill should be struck down.

As that is not possible because we have a one party government in the state now the only thing i would say that can be changed is to not require this for renewing a permit. Pistol Permit holders especially those with unrestricted permits are the most vetted people in the state. If they were a danger for any of the reason behind this bill they would not have a pistol permit. This bill specifically and unfairly targets a person for having a pistol permit and being gun owner.

The size and scope of something like this would require Hundreds, if not thousands of background checkers. And NY will gladly pay for it with more of your taxes.
