Another NYC Question

I'm wondering if anyone has experience or insight into this. In NYC we're limited to one gun purchase every 90 days. I'm thinking of buying online within the 90 days and picking up at the FFL on or after the 90 days. That could save me a couple of weeks. But not willing to risk it unless there is some definitive answer.

10-302.1b. No person shall acquire a firearm if such person has acquired a firearm within the previous ninety days. No person shall acquire a rifle or shotgun if such person has acquired a rifle or shotgun within the previous ninety days.

Not a lawyer but the code you quoted says acquire not purchase.

No experience here just a reasonable guess. If you buy the gun online to be shipped to FFL. don't do the background check to pick up and take possession of the gun until after the 90 day period is up, you are fine. Essentially you have not acquired it until you pass the BGC. The BGC seems to be the only way for anyone (fed or state) to know you've acquired a firearm.

You can do it but you'd be waiting longer than 90 days. At your 90 days you need to fill out and mail in your purchase authorization request to get a form. That takes a few days up to two weeks to process.

After you get approval for another pistol you need to schedule an appointment to pick up the form.

* If it will be the purchase of your fifth handgun you will need to purchase a gun safe prior and provide pictures of the front, rear and inside of the safe as well as a scan of your receipt prior to the issuance of your fifth purchase authorization.

Then you can go pick up your FFL and fill out the form 4473.

After you take possession you need to scan in your completed purchase authorization and receipt of purchase and email the Licensing Division to setup an appointment to have it inspected and added to your permit.

You are sorely mistaken if you think you can get one every 90 days, its more like every 120-150 days.

I have put down payments on guns while I've been waiting for my next PA approval.

Sorry, I thought you were talking about handguns. I've never run into an issue with this and long guns.

And the SCOTUS allowed the case to go away because NYC amended it's ways!!!

Not sure how this isn't viewed as limiting your rights to possess!
