In 2007 smollet was sentenced to probabtion over a DUI AND one of the charges was providing false information to police! Claimed when arrested to be his brother. This guy is a real piece of work.

Hard to say.
I will predict this, for what it's worth: if he fights this as one article last night/this morning claimed he would, he will get jail time. A plea is his only way out of this without jail time.
There's IMO 0% chance he gets out of this with an acquittal if he takes it to trial, and the prosecutors are not going to let it drop.
I'm listening to the press conference now by the Chicago PD. They had "questions" right from the get-go.
Chief just said "justice" at this point would be Smollet admitting what he did, apologizing, and then offering up resources (i.e. monetary restitution) for the wasted resources.
This is a remarkable case because it's rare to see somebody fuck up so good and proper. He really did a spectacular job with it. A crime with so many mistakes (camera, rideshare tracking, absurd story, etc.), and then fully two weeks after it happened he's on the news affirming it happened again and digging yet a deeper hole.
I believed in late Jan this was fabricated but we'd never get closure on it. But when the persons of interest were picked up, that finished it.
We haven't even heard from the feds. I find it difficult to believe they are going to let mail fraud with an FBI investigation go simply as a "jk lol".
He will plea out. He will have to admit all of his wrongdoings. He will have to admit to the truth. He will get probation, a fine and possible some restitution.

I heard on the radio by the Fox reporter in Chicago who basically is responsible for this story due to his reporting that the Nigerians who are from Chicago (not born in Nigeria) actually went to Nigeria for 2 weeks after the "crime" and the police were waiting for them at the airport when they landed back in Chicago without their knowledge lol. I would have loved to have seen their faces coming off the plane.
