Ar pistol brace legality question

I have a AR pistol with a pinned magazine. The mag is not removable so it isn't an assault weapon under NY law. Is there any reason that a law folding brace wouldn't be legal? It's not a stock it's a brace as declared by atf. I don't know of any NY law that would ban a folding brace. Any opinions on legality that are legally based? Thanks, Woody

It is on my permit. It is the law folder with shockwave blade. The entire setup is a compromise but I think it's still handy. I've mounted my sig Romeo 6 scope to it and I shoot steel to 300 yards messing around. It shines as a pistol re0lacement and is a lot easier to make hits from 0 to 100 yards. The downfall is having to side load or break the top o0en but it's the price we pay living in NY for now...... I normally keep it with a trijicon mro on it with a larue mount. I keep the mag full and chamber empty. Barnes 62 grain barrier blind copper rounds, I contacted Barnes and they say the round with perform down to 1800 fps so I'm not relying on fragmentation due to a 10.5" barrel. Soon I'll replace with a bravo company 11.5 for improved velocity and dwell time

Have you checked if the buffer retaining pin is putting teeny dents in buffer? (Sometimes a result of law tactical folder)

Freddy, I appreciate the heads up I didn't know about that potential. I have a law brace ordered but not here yet, I was curious if others new about the legality first. I will definitely keep an eye out for that. I currently just have the basic shockwave brace mounted.

Law tactical is aware of this issue. They will send free shims upon request. The shims resolve the problem.

Yes, and on multiple makes of AR. Search Ar15.com and you can find a discussion there. Law tactical must err on the side of making the extension slightly loose, then give out shims when asked. Other than the weight the Law folder is great. Built like a tank.

Because since the pistol cannot accept a detachable magazine, any banned feature doesn't apply. Regardless, a folding brace isn't a banned feature. A folding stock is.

(c) a semiautomatic pistol that has an ability to accept a detachable magazine and has at least one of the following characteristics:

(i) a folding or telescoping stock;
(ii) a thumbhole stock;
(iii) a second handgrip or a protruding grip that can be held by the non-trigger hand
(iv) capacity to accept an ammunition magazine that attaches to the pistol outside of the pistol grip;
(v) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
(vi) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned;
(vii) a manufactured weight of fifty ounces or more when the pistol is unloaded;

If your AR is on your permit and the magazine is pinned then folding or not is fine. It’s just a pistol that is not an assault weapon and therefore is excempt from those ridiculous rules. A stock would make it a SBR

Thank you for helping everyone. I read the law but I had a disagreement with someone at a local gun store who claimed that wouldn't apply to a folding stock. Obviously he's technically correct but we were arguing over a shock wave brace not a stock so he's wrong. Good stuff

For the most part gun store flys (or workers) and LEOs are not great sources for firearm legal advice..

Few years ago I ordered a VZ58 (well the centuy arms 2008 version) and had the gun store down in PA perm. attach the magazine, and pinned the magazine to 9 rounds (he guestimated and tried for 10, got 9 I wasn' mad) it was a side folder (loved that gun)

When I was down checking it out before it got a New Yorked up, there was a NY cop in the shop over heard me and the gunsmith talking and looked at me and told me "be careful, i won' do anything if I was to see you with that, but if you have that stock folded in New York it will turn that gun into a handgun and some cops might arrest you....."

I looked right at him and told him no you are wrong no way for a rifle to become a handgun

He insisted that it was with the stick folded

So again i told him no and to please look over the laws before you start misquoting them and become a liability to your department.... he was not happy with me (and I said it very respectfully)

May we ask which local gun store?

Supposedly only the arm braces that are soft and rubbery and can go around your arm are ok with the ATF (shouldering). Stuff like the blade isn't. Now what you do from there and who will know is up to you.

I don't mean any disrespect I just don't automatically want to attach the gunstore to my conversation if it was unrelated to them. GunSlingerBoy- I didn't know that my armbrace couldn't be shouldered. I was not aware that the SB was good to go but the blade wasn't. I appreciate you linking the video, I am going to E mail the blade makers and see what they say beyond the material they have posted on their website. Good news or bad I appreciate all of the info. -Woody

No problem Art. I would say the best course of action would be to contact the ATF directly but like they said in the video that can create more problems again. It's a ridiculous thing all together because it seems that the ATF is saying you can't reclassify something based on its use while at the same time saying that something can be reclassified based on it's use. They are saying the rubber ones are good to go because you can't reclassify the pistol to a rifle if used in a different way than it's original intended use. Hence shouldering. But then they say the blade can reclassify the pistol if used in a different way than it's intended use. If shouldered. It's all nonsense.

I wouldn't say to get either "over" the other unless you have a very specific use in mind for one or the other. Besides them being on an AR platform (if that's what someone has them on) the calibers are totally different beasts. It all depends on what you want to use them for. Or it could be as simple as liking one more than the other. I already had a 556 AR so I wanted to build a 300blk just for the fun of it. I must say I do enjoy shooting the 300blk more than the 556 by a wide margin. I tend to like 30 cals over 22 cal. Both can be run suppressed and I in fact do run each quiet sometimes. Since I don't hunt it's merely for fun. If you can get both do it.
