AR pistol Legality: Good to go or No No?

Today my question to all of you is as follows; Based on NYs definition of a pistol and what makes an "ASSAULT PISTOL" I can see merit to its questionable legality. There are 3 main factors to my perspective

- The first is, if it has a handguard/ rail/ etc. That would, technically, constitute a barrel shroud.

-The second concern is the weight limit on pistols in ny (50 oz).

-The final concern is confusion in the language of the SAFE ACT regarding if it follows the same standard as rifles where a fixed magazine creates the exception of the list of banned features.

Thanks for any input on this guys. I'm hoping to hear some opinions from LEO as well.

It's really quite simple. The features you are mentioning are irrelevant now. Prior to SAFE there were AR style pistols around that were very stripped down, with those features being relevant, because one 'feature' was allowed essentially. After SAFE , no features allowed. As one banned characteristic is a magazine that attaches outside of the pistol grip, the things you mention no longer matter in an AR style pistol. You can't have an AR pistol unless it's got a fixed magazine or it's not semi-auto, simple as that.

We had LEOs opinions in all sort of directions that is no different from the answers one might get from NYSP that can be quite quite arbitrary depending on weather and contradicting in some cases.

In terms of AR pistols they need to be mutilated to be NY SAFE compliant, and unless you are a privileged citizen with an exception like a cop or detective.

A handguard in an AR is an integral part of the receiver upper not a shroud.
Aside from being super scary bad and Evil and all that, an AR pistol is quite a waste and pretty useless in the real world.

Not only that but on top, any semiautomatic system, pistol or rifle, with mag release that looses either of those two primary functions is even worse no matter if it is a fixed mag or cancelled autoloader..
It looses all the value that it could have tactically and functionally talking.

Best thing about compliance in NY or any US state is to call to the nr. in your State. Be ready for some confusion depending who picks up the phone.

The only way to have a NY legal AR pistol is via a fixed magazine.

I have an AR pistol on my unrestricted permit, got it put on back in 2020. Magazine is fixed, can’t be removed, and to get it approved on my permit, I had to submit the purchase information for the upper I put on it. (Psa marauder).

now with all the issues with braces, I have an SB tactical brace, but I am going to switch back over to the shockwave technologies blade, but even that I am not sure it’s safe from the new ATF rules about braces.
Not sure if I should just get it removed from license and turn it into another neutered rifle

I had one I built in NY, and I never cared for the brace so I removed it years ago.

I just get a cheek weld to the bare buffer tube and forgo shouldering it at all.

Recoil from .223 in a 7" barrel does not need to be shouldered lol.

And I'm never going to be taking 300+ yard shots with an AR pistol with a 7" barrel anyway, so the extra stability isn't important either.

And I'm never going to be taking 300+ yard shots with an AR pistol with a 7" barrel anyway, so the extra stability isn't important either.

Sure is fun to shoot, though.
