He must have listed this as his residence and signed off on it. I’ve also seen where they can enter another residence if they know you are there. Again check NY specifically but this is generally how it works. No warrant needed. If it wasn’t lawful they all wouldn’t be there doing it. lol. Think. There are strict requirements, training and qualifications to be licensed as a Bondsman. This is NY after all. Do you really think you know more than they do because you heard a story once from your neighbors uncles sister at a bbq? I’m sure all the cops were in on it too. All risked their careers and freedom just because they thought it’d be fun. Good grief.

Youre not kidding. But MOST people are not prepared for a situation like this.

Im guessing this guy is not a gun owner since the story didnt mention him grabbing his gun before approaching the door.

I think MOST people would be caught off guard in a situation like this since most people dont encounter violence enough to be ready. The one aspect of this story that complicates things is he looked outside and saw police. At that point article 35 does NOT cover you to use DPF (iirc).

Imo, the best way to handle a bump or banging at the door in the middle of the night would be as follows.
As soon as banging is heard the wife should be calling 911 while the dad grabs his gun and takes up a defensive position behind cover, and yells at the thugs "Do not enter, I am armed (and yell it loud enough for the 911 call to record it). If that door gets kicked in, and he sees no uniform or identification then he should be justified to shoot. As any reasonable person could believe its a home invasion.

Now, if while on 911, the operator confirms there are police there then legally you can no longer use dpf. And if these thugs still break in without a warrant then your only legal recourse is to sue.

I think this would be the best way to handle the shitty situation, but Id like to hear from any professional if this is a sound plan.

In similar situations the agents would need to have reason to believe - more than a hunch - that you are in fact staying at the residence. It is also likely the case here and is reasonable to think it would apply here to bounty hunters. As cited above, no warrant needed. Contact the Supreme Court if you want to debate it. It was their call.

I recall an episode of law and order that focused on this topic. A couple of bounty hunters went into an apartment looking for someone that jumped bail and the result was a bloodbath. The cops and the DA wanted to charge them but the lawyer for the bounty hunters pointed out that bounty hunters have the right to do things the police cannot based on law from almost a couple hundred years ago (if I recall correctly). Of course in the show a way was found to bring the bounty hunters to justice.

What makes you think the family isn’t lying and the criminal just happened to not be there at the time? What makes you think he didn’t just leave? Was tipped off? Went out the back? You are the one making accusations and therefore up to you to show how the set and legal process is being violated.

It’s funny how this whole thread was just derailed by a quick search revealing that it was lawful and no warrant was needed. All of the “I would have shot!” Comments now looking incredibly stupid. That would only end with you going bye bye for a very long time as their presence and entry (if they even entered) is all lawful. Yes they take risks but it is a dangerous job they have accepted. To your point, we dont have all the info. But I take issue with how this was handled regardless. Id be curious to find out if this was his residence or not. If not, these wannabe cops need to be charged appropriately.
