My personal phone was used on duty until they changed the discovery laws in NY. It is NOT subject to FOIA.
It is now, however, subject to subpoena if I use it in the course of my duties.

If a police officer take a photo at a crime scene their phone is now able to be subpoenaed.

Correct. A subpoena is required.
FOIA does not cover personal phones.
