It's a stretch to say that a line worker would have the wherewithal to not only have the resources, but business acumen to open a competitor! Especially if it (business) isn't next door, there would be no valid claim for loses either.
No compete clauses are usually reserved for those levels of executive employees that CAN actually steal clients and business... Just sayin...
Non competes are a wage suppression tool and anti free market. No raise for you and you can't quit because you can't ply your trade elsewhere if you sign one. Businesses that want them are basically saying: "go work for the wage we decide you useless fucking peon".When I was still doing auto body work I had a guy wanting me to sign a non-compete agreement, he waited till I showed up for the first day with my tools and then hit me with it. I refused to sign as I did a lot of 'side work' then and that agreement would've kept me from leaving and going to another shop. I didn't stay there long, should've listened to the guys that said he was a dick.
